PROPOSED IMPOSITION OF CIVIL PENALTY - $40,000 This is to inform the Coninission that a Notice of Violation and Proposed l

Imposition of Civil Penalty in the amount of $40,000 will be issued on or about July ~7, 1986 to Kansas Gas & Electric Company. This action is based on a single vidlation which involved the potential for unauthorized, undetected accesssfrom the owner controlled area into a vital area which was categorized at a Severity Level II. The base civil penalty is reduced by 50% because of the licei1see's prior good. performance and prompt and extensive corrective action.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

Mailing of Notice July 7, 1986 Telephone Notification of Licensee July 7, 1986 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Kansas will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
