SUBJECT:

UPDATE OF NUCLEAR REGULATORY COMMISSION (NRC) DISTRIBUTION LIST FOR DOCUMENTS CONTAINING OFFICIAL USE ONLY (OUO) AND SAFEGUARDS INFORMATION (SGI)

Dear Mr. Waldrep:

I am writing to request current information on those individuals authorized to receive documents containing Safeguards (SGI) and Official Use Only (OUO) information on issues relating to your facility. Safeguards information is a special category of sensitive unclassified information authorized by Section 147 of the Atomic Energy Act of 1954, as amended (the Act), to be protected. While Safeguards information is considered sensitive unclassified information, it is handled and protected more like classified confidential information than like other sensitive unclassified information (e.g., privacy and proprietary information). Access to Safeguards information is controlled by a valid need-to-know basis.

It is the responsibility of the NRC, to maintain the integrity of Safeguards information distribution.

We are in the process of verifying the identity and contact information of individuals designated to receive documents with SGI and OUO information for your facility. Please provide an updated distribution list of those persons who should receive documents containing SGI and OUO within 60 days from this letter to: ATTN: Document Control Desk, Washington, D.C. 20555-0001; with a copy to the Regional Administrator Region II, so that we can verify and/or update our distribution information. I have enclosed a current official distribution list for those documents made available publicly. Additionally, you will find NRC Regulatory Issue Summary 2005-26 defining control of sensitive unclassified non-safeguards information related to nuclearpowerreactors, and NRC Regulatory Issue Summary 2003-08, Summary of Safeguards Information Requirements.

PAPERWORK REDUCTION ACT STATEMENT This letter contains information collection requirements that are subject to the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.). These information collections were approved by the Office of Management and Budget, approval number 3150-0011.

Public Protection Notification The NRC may not conduct or sponsor, and a person is not required to respond to, a request for information or an information collection requirement unless the requesting document displays a currently valid OMB approval number.
