This is to confirm our telephone conversations on December 18 regarding a possible extension of time for the Department of Justice to respond to Houston's Third Set of Interrogatories, et al. to the Department.
You requested an extension from January 2, 1980, until February 1, 1980, in which to respond.                         Given the limited number and narrow focus of our interrogatories, a thirty-day extension is not reasonable. Our position is that we would consent to an extension until January 17, the date when the Department's documents are due.                   No agreement was reached.

RESPONSE OF HOUSTON LIGHTING & POWER COMPANY TO DEPARTMENT OF JUSTICE MOTION FOR EXTENSION OF TIME For the second time within a twelve day period, the Department of Justice has moved for an extension of time seeking to defer answering various Houston Lighting & Power Company

[" Houston") interrogatories until the final four weeks of factual discovery.

The Department has previously so moved with respect to supplementing Houston's first set of interrogatories (Motion dated December 14, 1979.)

Now, the Department wants an extension until February 1 in which to answer Houston's Third Set of b!

k The Department's answers to those interrogatories are due January 2 and its responsive documents are due January 17.

Houston has already offered the Department an extension to January 17 for those interrogatories, but the Department now indicates that it wants still more time.

As set out in Houston's December 20, 1979 Response to the Department's request for an extension of time to provide substantive answers to Houston's First Sec of Interrogatories, February 1 is simply too late to permit Houston to effectively conduct further discovery on the basis of any information disclosed for the first time in the Department's answers.

The Department should not be permitted to postpone providing Houston with the important information sought in its interrogatories until the final weeks of discovery.

Therefore, Houston requests that the Department be ordered to provide answers and documents in response to Houston's Third Set of Interrogatories by January 17, 1980.

Dear Ms. Cyphert:

This is to confirm our telephone conversations on December 18 regarding a possible extension of time for the Department of Justice to respond to Houston's Third Set of Interrogatories, et al. to the Department.

You requested an extension from January 2, 1980, until February 1, 1980, in which to respond.

Given the limited number and narrow focus of our interrogatories, a thirty-day extension is not reasonable.

Our position is that we would consent to an extension until January 17, the date when the Department's documents are due.

No agreement was reached.

Under the current schedule discovery closes on February 29, and production on February 1 simply does not allow sufficient time for Houston to resolve potential problems in your responses and to take follow-up discovery based on your responses and document production.
