ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a White Significance Determination Process finding will be issued on or about March 26, 2015, to Exelon Generation Company, LLC (licensee) as a result of an inspection at Dresden Nuclear Power Station, Unit 3 (Dresden 3). The White finding, an issue of low to moderate safety significance, will result in additional NRC inspection and potentially other NRC action.
ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a White Significance Determination Process finding will be issued on or about March 26, 2015, to Exelon Generation Company, LLC (licensee) as a result of an inspection at Dresden Nuclear Power Station, Unit 3 (Dresden 3). The White finding, an issue of low to moderate safety significance, will result in additional NRC inspection and potentially other NRC action.  
The White finding involved the licensee's failure to establish measures for the selection, and review for suitability of application of materials, parts, equipment, and processes that are essential to the safety-related functions of the structures, systems, and components involving the Dresden 3 Automatic Depressurization System (ADS). Specifically, from November 29, 2010, to November 6, 2014, the licensee failed to establish measures to ensure that the application of the ADS electromatic relief valve (ERV) actuators remained suitable for operation. This resulted in multiple failures of the ERV 3E during testing prior to operating cycle D3C23, and an indeterminate period of inoperability and unavailability greater than allowed by Technical Specifications during operating cycle D3C23. The ERV 3E inoperability during the operating cycle was identified after the failure of the valve during its first operational test following unit shutdown for refueling. A NOV is included based on the licensee's failure to establish measures for the selection, and review for suitability of application of materials, parts, equipment, and processes that are essential to the safety-related functions of the structures, systems, and components in accordance with 10 CFR 50, Appendix B, Criterion III, "Design Control".
On March 2, 2015, the licensee declined the opportunity to discuss this issue in a Regulatory Conference or to provide a position on the finding and violation in writing. The licensee has not yet been informed of the specific nature of the enforcement action.
