RESCISSION OF ORDER EA-05-007, "ORDER IMPOSING ADDITIONAL SECURITY MEASURES" On July 19, 2005 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML051860304 and ML051860308), as corrected by letter dated August 16, 2005 (ADAMS Accession No. ML052100039), the U.S. Nuclear Regulatory Commission (NRG or Commission) issued Order EA-05-007, "Order Imposing Additional Security Measures," to power reactor licensees and research and test reactor licensees. This order imposed additional safeguards and security measures for the transportation of radioactive material quantities of concern. On March 19, 2013, the NRG published Part 37, "Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material," to Title 10 of the Code of Federal Regulations (10 CFR). This final rule establishes security requirements on licensees possessing Category 1 or Category 2 quantities of radioactive materials. Many of these security requirements were previously imposed by orders, including Order EA-05-007. As of March 19, 2014, affected licensees were to be in compliance with this rule. The Commission's March 16, 2012, Staff Requirements Memorandum (SRM M120316), which approved the final rule for Part 37, included the Commission's approval to rescind the related security orders in accordance with the implementation plan in SECY-11-0170, "Final Rule: Physical Protection of Byproduct Material (RIN 3150-Al12)," dated December 8, 2011. The implementation plan stated that Order EA-05-007 would be rescinded after the implementation period of the rule (i.e., March 19, 2014). Accordingly, effective immediately, the NRG is rescinding Order EA-05-007 for the power reactor licensees listed in Enclosure 1 and the research and test reactor licensees listed in Enclosure 2. Portions of Order EA-05-007 are not publicly available since it contains Safeguards Information. Licensees must continue to protect this Safeguards Information in accordance with NRG regulatory requirements. Licensees may destroy copies of Order EA-05-007 when no longer needed, per 10 CFR 73.22(i), "Destruction of Matter Containing Safeguards Information," or 73.23(i), "Destruction of Matter Containing Safeguards Information Designated as Safeguards Information-Modified Handling," as appropriate.
