| ViolationB.10CFR71.5requiresthatlicenseeswhotransportlicensedmaterialoutsidetheconfinesoftheirplantscomplywiththeapplicablerequirementsappropriatetothemodeoftransportoftheDepartmentofTransportation(DOT)09CFRParts170through189.09CFR173.025(b)(l)requiresthatpackagedshipmentsoflowspecificactivity(LSA)materialconsignedasexclusiveusemustbepackagedinaDOTSpecification7ATypeApackageorinastrong,tightpackagesothattherewillbenoleakageofradioactivematerialunderconditionsnormallyincidenttotransportation.Contrarytotheabove,thelicenseefailedtopackageashipmentofLSAradioactivematerialinaDOTSpecification7ATypeApackageorastrong,tightpackageinthatonOctober22,1985,shipmentNo.85-09arrivedattheburialfacilitywithaholeinoneB-25metalbox.ResponseB.l.FloridaPowerandLight(FPL)concurswiththisviolation.2.Baseduponalloftheevidenceconsidered,FPLbelievesthemostprobablereasonfortheviolationwasduetopersonneloversightduringinspectionoftheradioactivematerialsshipment.3.Theshippingprocedurehasbeenchangedtoprovideforamorethoroughinspectionofcontainerspriortoshipment.Therehavebeennoviolationssincethisfinding.Theinitialcorrectiveactionsaresufficienttoavoidfurtherviolations.5.Fullcompliancehasbeenachieved.PSO1Page2of3 ViolationC.10CFR20.103(c)(2)providesinpartthatthelicenseesmaymakeallowanceforuseofrespiratoryprotectiveequipmentinestimatingexposuresofindividualstoradioactivematerialsinairprovidedthatthelicenseemaintainsandimplementsarespiratoryprotectionprogramthatincludes,asaminimum,writtenprocedureregardingsupervisionandtrainingofpersonnelandmaintenanceofrecords.Contrarytotheabove,onApril18,1986,theNRCinspectornotedthelicenseewasmakingallowanceinitsMaximumPermissibleConcentrationhourassignmentrecordsforuseofrespiratoryprotectiveequipmentinestimatingexposuresofindividualstoradioactivematerialinairforpurposesofdeterminingcompliancewith10CFR20.103.However,thelicenseedidnothavewrittenproceduresregardingmaintenanceofrecords'showingthatanindividualhadbeenissuedarespirator.ResponceC.1.FloridaPowerandLight(FPL)concurswiththisviolation.2.TheviolationwasduetoanincorrectinterpretationoftheregulationsbytheHealthPhysicsGroup.3.Theissuanceofrespiratoryprotectiondeviceshasbeenproceduralized.Therehavebeennoviolationssincethisfinding.Theinitialcorrectiveactionsaresufficienttoavoidfurtherviolations.5.Fullcompliancehasbeenachieved.PSO:1Page3of3 t
