This letter documents our approval of your request to receive a copy of the final interim compensatory measures (ICMs) for Category III fuel cycle facilities for the purpose of coordinating the preparation of an implementation guidance document for the industry. We concluded that you are serving as an agent for the Category III fuel cycle licensees and you have a need to know the information. The ICMs have been prepared for pick up at our office per your request.
The ICMs are safeguards information and must be protected pursuant to the requirements in 10 CFR Part 73.21. Violation of the protection requirements is subject to civil and criminal penalties.
