Dear Mr. Runkle:
Your petition dated September 20, 2006, addressed to Luis A. Reyes, Executive Director for Operations at the Nuclear Regulatory Commission (NRC), and filed on behalf of numerous petitioners, has been referred to me pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Section 2.206. You request that the NRC immediately issue an Order suspending the Shearon Harris Nuclear Power Plant (SHNPP) operating license until SHNPP is in compliance with fire safety regulations. As the basis for your request, you discuss several fire safety violations at SHNPP which could affect the safe operation of the plant and safe shutdown of the plant in emergency situations. I would like to express my appreciation for your effort in bringing these matters to the attention of the NRC.
The Petition Review Board (PRB) met on October 10, 2006, to discuss your request for immmediate action to revoke SHNPPs operating license. The PRB denied your request for immediate action based on the staffs determination that there was no immediate threat to public health and safety. You were notified of this by phone on October 17, 2006.
In a public meeting at NRC Headquarters on November 13, 2006, you met with the PRB to present additional relevant information concerning your petition. The supplemental documents dated October 23 and 30, 2006, and submitted on October 23 and November 13, 2006, have been entered into the NRCs Agencywide Documents Access and Management System (ADAMS) under accession numbers ML062980107 and ML063200168, respectively. The results of that discussion and the supplemental documents have been considered in the PRBs determination regarding your petition and in establishing the schedule for the review of your petition.
After considering the petition request, and information provided at the public meeting, the PRB has determined that your request does meet the criteria for acceptance as a 10 CFR 2.206 petition.
J. Runkle As provided by Section 2.206, we will take action on your request within a reasonable time.
Chandu Patel will be taking over as petition manager for your petition. Mr. Patel can be reached at 301-415-3025. Your petition is being reviewed by the Fire Protection Branch in the Office of Nuclear Reactor Regulation. I have referred to the NRC Office of the Inspector General (OIG) those allegations of NRC wrongdoing contained in your petition. I have enclosed for your information a copy of the notice that is being filed with the Office of the Federal Register for publication. I have also enclosed for your information a copy of Management Directive 8.11, Review Process for 10 CFR 2.206 Petitions, and the associated brochure NUREG/BR-0200, Public Petition Process, prepared by the NRC Office of Public Affairs.
Sincerely,
/RA/
