This letter responds to your {{letter dated|date=November 16, 2006|text=November 16, 2006, letter}} containing the Nuclear Energy Institute (NEI) detailed concerns regarding the NRC Regulatory Issue Summary (RIS) 2006-14, Enforcement Discretion for Facility Changes Under 10 CFR 70.72(c)(2), dated September 22, 2006.
Following the U.S. Nuclear Regulatory Commission (NRC) policy and procedures, the RIS was provided to licensees, for information only, to inform them of the proposed Direct Final Rule (DFR), Facility Change Process Involving Items Relied on for Safety (Federal Register, Vol. 71, No. 187, p. 56344, September 27, 2006). On December 1, 2006, a Federal Register Notice was published that confirmed that no significant adverse comments on the proposed DFR were received by the NRC and that the DFR will become final on December 11, 2006, (Federal Register, Vol. 71, No. 231, p. 69430). Because the DFR is now final, the RIS and the associated Enforcement Guidance Memorandum (EGM) that was issued to NRC inspectors (EGM-06-005, October 17, 2006) no longer applies.
On October 27, 2006, the NRC received the NEIs comments on the proposed DFR, which stated that the NEI recommended no changes to the proposed DFR; however, it had concerns with the RIS. These concerns were expressed in detail in the letter from the NEI to the NRC, dated November 16, 2006. The NRC appreciates your detailed comments. As mentioned earlier, as of December 11, 2006, the RIS is no longer applicable; however, we believe it would be beneficial to hold a workshop with stakeholders to discuss the concerns raised in your letter.
