The ESA requires that federal agencies consult with NMFS when endangered marine species may be affected by a federal action. NRC staff also discussed with Ms. Crocker historic impingement of shortnose sturgeon at Indian Point, Units 2 and 3.

Ms. Crocker suggested that the NRC staff discuss potential effects on the Atlantic sturgeon in the text of the Indian Point Draft Supplemental Environmental Impact Statement. Should the Atlantic sturgeon be listed under the ESA prior to the completion of the Indian Point license renewal review, the NRC staff may need to amend the BA or take other action to address potential impacts of license renewal on the Atlantic sturgeon.
