To the Vermont Yankee ASLB and parties, On May 15, 2008, counsel for the Commonwealth of Massachusetts received an e-mail from Laura Bregman, notifying the parties that the ASLB will hold a prehearing telephone conference on June 24, 2008. Presumably, the purpose of the conference is to prepare for the upcoming adjudicatory hearing on the New England Coalition's admitted contention.

As stated in the Commonwealth of Massachusetts' May 6, 2008, Notice of Intent to Participate as an Interested State, the Commonwealth seeks to participate in this proceeding for the purpose of protecting its right to ensure that the issues raised in the Commonwealth's single contention in this case will be resolved before the NRC issues any, renewed, operating license for the Vermont Yankee nuclear power plant. Therefore, the Commonwealth does not intend to participate in the hearing regarding NEC's contention. Accordingly, unless otherwise requested by the ASLB, the Commonwealth does not intend to participate in the June 24 prehearing telephone conference call.
