ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a White Significance Determination Process finding will be issued on or about September 16, 2015, to Exelon Generation Company, LLC (licensee) as a result of an inspection at Dresden Nuclear Power Station, Unit 2 (Dresden 2). The White finding, an issue of low to moderate safety significance, will result in additional NRC inspection and potentially other NRC action.

Specifically, from December 1, 2009, to February 7, 2015, the licensee failed to establish measures to ensure that the application of the ADS electromatic relief valve (ERV) actuators remained suitable for operation.
This resulted in a failure of the 2C ERV, and an indeterminate period of inoperability and unavailability greater than allowed by the technical specifications. The 2C ERV inoperability was identified after the failure of the valve during its first operational test in a mid-cycle outage.
Additionally, because the licensee was not aware of the valves inoperability between 2013 and 2015, the required technical specification actions were not followed.
A NOV is included based on the licensees failure to establish measures for the review for suitability of application of parts that are essential to the safety-related functions of systems and components in accordance with Title 10 of the Code of Federal Regulations (10 CFR) part 50, Appendix B, Criterion III, Design Control.
On August 13, 2015, the licensee indicated that they did not contest the NRC characterization of the violation or the risk significance of this finding. Further, the licensee declined to discuss this issue in a Regulatory Conference or to provide additional information in a written response.
