On November 30, 2015, Palisades Nuclear Plant (PNP) provided a written response to U.S. Nuclear Regulatory Commission (NRC) Inspection Report 05000255/2015003
This is a follow-up letter to the U.S. Nuclear Regulatory Commission (NRC) acknowledgement of disputed violation of NRC Inspection Report (IR) 05000255/2015003. Specifically, on December 21, 2015, the NRC acknowledged your letter sent to the NRC, dated November 30, 2015, that contested a Non-Cited Violation (NCV) documented in our IR issued on October 30, 2015. The contested NCV is Failure to Justify Continued Service of Safety-Related Electrolytic Capacitors Installed Beyond their Service Life.

The letter explained PNP agreed a performance deficiency occurred but disagreed the deficiency was associated with a violation of Title 10 of the Code of Federal Regulations
, Part 50, Appendix B, Criterion III, "Design Control," as stated in the inspection report. The letter further stated PNP believed the performance deficiency was associated with 10 CFR Part 50, Appendix B, Criterion V, "Instructions, Procedures, and Drawings."


The NRC carefully reviewed PNP's reply and determined the Non-Cited Violation should be changed to a violation of Technical Specifications Section 5.4.1, "Procedures
The NRC seeks to provide a thorough response to disputed violations within 90 days of receipt of licensees points of contention, as described in Section 2.2.8 of the NRC Enforcement Manual, Part I. However, the NRC review of this disputed violation is expected to take longer than 90 days as we pursue a generic Agency position for the industry. In the interim, we understand you have entered the underlying technical issue into your Corrective Action Program, as discussed in IR 05000255/2015003. We will inform you as soon as we complete our evaluation.

Dear Mr. Vitale:
