The Nuclear Regulatory Commission (NRC) has implemented, on an interim basis, the

. Integrated Materials Performance Evaluation Program (IMPEP) used in the evaluation of Agreement State programs. Enclosed for your review is the draft IMPEP report that j

documents the results of the Agreement State review held in your offices on December 2 - 6, L

1996. : Mr. James Myers, Office of State Programs, was the team leader for the Tennessee review. The review team's recommendations were discussed with Mr. Kenneth W. Bunting, Administrator, Land and Radiation Programs, Mr. Michael H. Mobley, Director, Division of l

Radiological Health (DRH) and members of the DRH on, December 6,1996.

NRC has significantly changed the manner in which periodic reviews are conducted for Agreement State programs. We made these changes to better assure that public health and safety are being adequately protected from radiation and that Agreement State programs are compatible with NRC's program. The new process, IMPEP, employs a team of NRC and Agreement State staff to assess both Agreement State and NRC Regional Office radioactive materitis licensing and inspection programs. All reviews use common criteria in the assessment and primary emphasis is placed on performance. Four additional areas have been identified as non-common indicators that are also addressed in the assessment. The final determination of adequacy and compatibility of each Agreement State program, based on the review team's report, will be made by a Management Review Board (MRB) composed l

of NRC managers and an Agreement State program manager who serves as a liaison to the MRB.

According to the IMPEP procedures, we are sending you a copy of the draft team report for your review before submitting the report to the MRB. Your review of the draft report should focus on factual correctness of information reported by the team. Specifically, in order to complete the evaluation of the compatibility of the Tennessee Agreement State Program, NRC requests that information be supplied that documents the Tennessee mechanisms that are equivalent of NRC's rule that addresses Decommissioning Recordkeeping Documentation of Restricted Areas and Spill Sites. I am asking that you provide your response to me within j

two weeks of receipt of this letter. I apologize for the delay in getting the draft report to you.
