NuScale Power, LLC (NuScale) submitted its Standard Plant Design Certification Application (DCA), in Reference 1, in accordance with the requirements of Subpart B, Standard Design Certifications, of 10 CFR 52. In Reference 2, the NRC was notified of NuScales intent to request a Standard Design Approval (SDA) based on the DCA design.

The purpose of this letter is to request approval of the NuScale design as described in the NuScale DCA, under Subpart E, Standard Design Approvals, of 10 CFR Part 52, upon completion of NRC staffs review and issuance of the Final Safety Evaluation Report.

NuScale also requests that the NRC publish its SDA determination and provide a copy of the SDA by letter to NuScale when it becomes effective. Issuance of the SDA will document completion of the staffs and the Advisory Committee for Reactor Safeguardss (ACRS) technical review of the NuScale Power Small Modular Reactor design.

The technical review of the NuScale DCA encompasses the requirements for review of SDA applications set forth in 10 CFR 52.139, Standards for Review of Applications. The NuScale DCA and its references contain information that Subpart E requires for a standard design approval (described in 10 CFR 52.136, Contents of applications; general information, and 10 CFR 52.137, Contents of applications; technical information). The scope of the requested approval also comprises content from the NuScale DCA not specifically required by Subpart E. The inclusion of this content ensures a more comprehensive licensing basis for use in subsequent licensing actions and any future updates to the NuScale design.

The attachment to this letter details the scope of NuScales request for Standard Design Approval, its corresponding location within the NuScale DCA, and pertinent information regarding its inclusion.

NuScale also requests that the Advisory Committee for Reactor Safeguards consider the same docketed and reviewed information as the basis for issuing a report pursuant to 10 CFR 52.53 and 10 CFR 52.141 for the NuScale DCA and SDA, respectively.
