SUBJECT: NRC INSPECTION REPORT 50133/97 02 AND NOTICE OF VIOLATION

Dear Mr. Rueger:

An NRC inspection was conducted on May 1315 and August 26-28,1997, at your

Humboldt Bay Power Plant No. 3 facility with addit;onaiinformation providc<1 via phone on

September 11,1997. The enclosed report presents the scope and results of that

inspection.

Major areas reviewed as part of the inspection included work related to reducing the

groundwater in-leakage into the reactor caisson, review of the current organization and

staff qualifications, adequacy of recent safety evaluations completed, evaluation of two

recently submitted Licenses Event Reports, and a review of the 1996 annual effluent report

and facility status report.

Based on the results of this inspection, the NRC has determined that ene violation of NRC

requirements occurred. This violation is cited in the enclosed Notice of Violation (Notice)

and the circumstances surrounding the violation are described in detail in the enclosed

report. This violation involved an improper alarm setting on the in line process monitor for

the liquid radwaste discharge line. This monitor is the final monitonng point for any

radioactive liquids released from the Humboldt Bay facility. Because of this, the in-line

process monitor performs a special and unique role to ensure that releases of radioactive

material do not occur above regulatory limits. Proper setting of the monitor's alarm is

critical to the operation of this system.

Please note that you are required to respond to this letter and should follow the instructions

.pecified in the enclosed Notice when preparing your response. The NRC will use your

response, in part, to determine whether further enforcement action in necessary to ensure

compliance with regulatory requirements.
