OF THE REACTOR OVERSIGHT PROCESS MONTHLY PUBLIC MEETING HELD ON AUGUST 26, 2020 On August 26, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public teleconference with the Nuclear Energy Institutes (NEIs) Reactor Oversight Process (ROP)
Task Force executives, and other senior industry executives, to discuss the staffs progress on the ROP initiatives. The topics discussed during this teleconference are described below.
Status of Significance Determination Process Guidance Revisions and Updates Multiple guidance documents related to the significance determination process (SDP) are under some form of revision or update. These include inspection manual chapters (IMCs) in the 0609 series and the 0308, Attachment 3 (bases) series. In support of the goal to review each IMC on a 5-year periodicity, most of the following IMCs revisions are minor in nature and mainly consist of updates to formatting and revisions to adjust for organizational changes since the last issuance date. At this time, it is not anticipated that these revisions would require Commission approval prior to implementation, however, the staff will follow the guidance for Commission notification consistent with COMSECY-16-0022, Proposed Criteria for Reactor Oversight Process Changes Requiring Commission Approval and Notification, and Management Directive 8.13, Reactor Oversight Process. The following documents are in draft, at various stages of the revision process, with a target issuance date before the end of the 2020 calendar year:

* IMC 0609, Appendix L, SDP for B.5.b On August 6, 2020 the NRC responded to a letter from NEI with recommended changes to the SDP appeal process. Both the NEI letter and the NRC response letter are publicly available under ADAMS Accession Nos. ML19261A190 and ML19324C685, respectively. The staff intend to begin the necessary revisions to IMC 0609, Attachment 2, Process for Appealing NRC Characterization of Inspection Findings (SDP Appeal Process), in the near term.
Status of Radiation Protection SDP The NRC staff discussed changes to the Public and Occupation Radiation Safety Cornerstone SDP. This effort will focus on IMC 0609, Appendices C and D and IMC 0308, Attachment 3, Appendices C and D. For the public SDP, the staff continues to pursue updates to the transportation SDP to address situations where licensees fail to use correct packaging and other updates as reflected under ADAMS Accession No. ML18178A100. The staff is also looking to incorporate 10 CFR Part 37, as well as further clarification of the transportation SDP into the public SDP. For the occupational SDP, changes will be administrative or clarifying in nature. The staff is not pursuing any changes to the logic or outcome-determining decision points in the occupational SDP. The NRC will host a public meeting in early October 2020 to discuss these changes in detail with interested stakeholders. During the public meeting the staff will review comments that were provided under ADAMS Accession No. ML18264A305.
Update on Implementation Activities for Independent Spent Fuel Storage Installation (ISFSI)
The NRC staff provided an update on the overall status of the ISFSI inspection program enhancement activities. For background, the staff discussed the final recommendations report and subsequent approval memorandum that have been publicly issued. The staff then presented a summary of the implementation activities that are currently ongoing and consist of revisions to the ISFSI inspection program documents and include the suite of ISFSI inspection procedures and IMC 2690, as well as a new IMC 2691 for the ISFSI inspection program technical basis. The staff also provided the location where implementation activity information and status could be found on the NRC public website. The staff is on track to complete implementation activities by the end of calendar year 2020.
Performance Indicator FAQ 20-03 and FAQ 20-04 NEI provided an overview of FAQ 20-03, Restoration of Train Monitoring After PRA Model Changes (ADAMS Accession No. ML20223A373), and FAQ 20-04, Crediting Automated Notifications in the DEP Performance Indicator (ADAMS Accession No. ML20223A363). The NRC staff will review FAQ 20-03 and FAQ 20-04, and plan to discuss their draft response the next ROP monthly meeting.
 
A. Masters                                      Meeting Action Items
: 1. NEI committed to providing examples associated with the Performance Indicator FAQ 20-04. Such examples will assist the NRC staff in understanding the FAQ as provided.
: 2. In the conversation of the Skype meeting, an industry member asked the status of 2 SECY papers associated with the ROP. Unfortunately, this question was not seen until after the meeting ended. The NRC staff response is provided below.
NRC Response: SECY-18-0113, Recommendations for Modifying the Reactor Oversight Process Engineering Inspections and SECY-19-0067, Recommendations for Enhancing the Reactor Oversight Process were provided to the Commission in November 2018 and June 2019, respectively. The staff is awaiting the Commissions decision regarding these recommendations.
Communicating with the NRC staff At the start of all ROP public meetings, the project manager provides contact information for the public to use to provide their name as a participant in the meeting. This contact information is also provided for submitting questions and comments to the NRC technical staff. Please note that any questions and/or comments pertaining to the ROP project can be sent to Tekia.Govan@nrc.gov. Questions and/or comments will be forward to the appropriate NRC staff. The staff also mentioned the role out of the Contact Us about ROP page on the new ROP website, which can also be used to submit questions and comments regarding the ROP initiative (https://www.nrc.gov/reactors/operating/oversight/contactus.html).
Conclusion At the end of the teleconference, NRC and industry management gave closing remarks. NEI expressed appreciation for the open dialogue and willingness of NRC staff to hear industry views. The NRC management stressed the importance of NRC being focused on providing reasonable assurance of public health and safety when considering changes to the ROP.
