ORDER Before the Commission is a Request by the State of New Hampshire for an extension of time to determine whether to file a Petition to Intervene and a Request for Hearing in the Seabrook Station Operating License Renewal Proceeding. This Request will be treated as a Motion for Extension of Time under 10 C.F.R. §§ 2.307 and 2.323.
The State originally sought an extension of 90 days from the date the Commission rules on a pending petition for rulemaking (which would increase the minimum operating time before an applicant could seek a license renewal) or 90 days from the current deadline for filing a Petition to Intervene, which is September 20, 2010. The State has now revised its request and seeks only an extension of 30 days. The Licensee opposes any extension of time. The NRC Staff consents to the States revised 30-day request.
Recognizing New Hampshires governmental interests, and the Staffs consent, I grant the State an extension of 30 days (until October 20, 2010) in which to file a Petition to Intervene and Request for Hearing.
Subsequently, Mr. Paul Gunter, representing Beyond Nuclear, and Mr. Raymond Shadis, representing Friends of the Coast and New England Coalition also filed requests for extensions of time. The Licensee and the NRC Staff oppose both new requests. I hereby grant Beyond Nuclear, Friends of the Coast, and New England Coalition an extension of 30 days in which to file a Petition to Intervene and Request for a Hearing.
