FINAL INTERIM COMPENSATORY MEASURES FOR CATEGORY III FUELCYCLE FACILITIES

Dear Mr. Killar:

This letter documents our approval of your request to receive a copy of the final interimcompensatory measures (ICMs) for Category III fuel cycle facilities for the purpose of coordinating the preparation of an implementation guidance document for the industry. We concluded that you are serving as an agent for the Category III fuel cycle licensees and you have a need to know the information. The ICMs have been prepared for pick up at our office per your request.The ICMs are safeguards information and must be protected pursuant to the requirements in 10 CFR Part 73.21. Violation of the protection requirements is subject to civil and criminal penalties. If you have any questions regarding this matter, please contact Kevin Ramsey of my staff at(301) 415-7887 or email at kmr@nrc.gov.In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter will beavailable electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
