Dear Mr. D acimo: On February 6 , 2006, the NR C staff completed its performance revie w of Indian Point Nucl ear Generating Units 2 and 3. Our te chnical sta ff reviewed p erformance indicato rs (PIs) for the most rece nt qu arte r and ins pect ion resu lts for th e pe riod from J anua ry 1 thro ugh December 31, 20

05. The purpose of this letter i s to inform you of our assessment of y our safet y perfo rmanc e during this peri od and our plans fo r fut ure inspe ctions a t your f acility.This performance rev iew and enclosed i nspection pl an do not i nclude phy sical protec tion information. A se parate letter de signated and marked as "Official Use Onl y - Securi ty-Related Information" wil l includ e the phys ical protecti on review and resultan t inspection plan.Overall, Indian Point Unit 2 (IP2) and Unit 3 (IP3) operated in a manner that preserved public health and safety and fully met all corn erstone objectiv es. Plant p erformance at IP2 for the most recent quar ter was within the Regulatory Response column of the NRC's Action Matrix based on a fi nding of low to mode rate sa fety si gnifica nce (White) in the Mit igatin g Syst ems cornerstone. This finding was identified i n the second quarter of 2005 and i nvolve d degradation of the safet y injection system over a period of several weeks. In December 2005, the NRC complet ed a Supplem ental In spectio n for t his find ing and c oncluded that Ent ergy's correc tive actions to pre vent recurrenc e of the underly ing causes w ere adequate. Pl ant performance at IP3 for the most recen t quarter, as wel l as for the first three quarters of the insp ection cyc le, was w ithin the L icensee Re sponse colu mn of the NRC's Action M atrix, based on all i nspection findings being cl assified as ha ving very low sa fety significance (Green) and all PIs indic ating performan ce at a lev el requ iring no add ition al NR C ove rsight (Green). Regarding the subs tantive cros s-cutting issue in the area of Problem Identifica tion and Resolution (PI&R) at IP2, we exa mined PI&R re lated findings from the last twel ve months, includin g results from the PI&R team inspecti on in June 2005 and th e Supplementa l Inspection in December 2 005. Althou gh several find ings related to corrective action issu es were i dentified, we did not identify any new or continued common theme that w ould wa rrant maintaini ng open the cross-cutting i ssue for PI&R. In particular, the re have be en no addi tional ex amples involv ing weak correc tive acti on evalu ations that co ntributed to a plant transie nt or degradation of safety equip ment du ring th e las t six months of the a ssessme nt peri od. We consi der cl osure of the cross-cutting i ssue in the area of PI&R app ropriate at thi s time based o n an assessmen t

Our oversight of y our corrective a ction program impl ementation w ill conti nue as part of the reactor oversi ght proces s (ROP) basel ine i nspect ion p rogram.On October 31, 2005, a Deviation fr om the ROP for Indian Point was approved by the NRC Executiv e Director of Operati ons. This acti on was taken to enable e nhanced NRC oversight of Entergy's performance re lative to addressing i ssues associ ated with the IP2 spen t fuel pool leakage, includ ing tritium conta mination; and improving re liabili ty and av ailabil ity of the Al ert and Notification S ystem (ANS), i ncluding impl ementation of backup power require ments.In summa ry, In dian Point Units 2 and 3 ope rated s afely and a re curr ently in th e Regul atory Response and Licensee Response columns of the NRC's Action Matrix, respectively. The NRC close d a lo ng-stand ing PI&R subs tantiv e cross-cutti ng issu e on U nit 2. Addi tiona lly , an RO P Deviatio n Memorandu m remains in e ffect for this station.

The enclosed inspection plan detai ls inspecti ons for Indian P oint Units 2 and 3, le ss those related to phy sical protec tion, schedul ed through Septembe r 30, 2007. R outine ROP b aseline inspections and additi onal insp ections of yo ur preparations for dry cask storage o f spent nuclear fuel a re included. In additi on, special ized in spections of Ente rgy's actions to address tritium contamin ation and to improve the ANS are pl anned in a ccordance w ith the Dev iation from the ROP. The timin g of some inspectio ns is depen dent on yo ur ongoing action s; as such, we wi ll coordi nate with your staff regarding add itional i nspections w hich either have not y et been schedul ed, or wi ll need to be moved.

The inspection plan is provided to allow for the resolution o f any schedul ing conflicts an d personnel availab ility i ssues wel l in adv ance of inspectors arri ving onsite. Routine re sident insp ections are n ot listed du e to their on going and continu ous natu re. The inspect ions in the last nine m onths of the inspe ction pla n are ten tative and m ay be r evise d at t he mi d-cyc le rev iew.In acco rdance wit h 10 C FR 2.3 90 of th e NRC's "Ru les o f Practi ce," a copy of this lette r and i ts enclosure will be made available electronically for public inspection in the NRC Public Docume nt Roo m or from t he Pub licl y Av aila ble R ecords (PARS) compo nent o f NRC's document syste m (ADAMS).
