Dear Mr. Runkle:

Your petition dated September 20, 2006, addressed to Luis A. Reyes, Executive Director forOperations at the Nuclear Regulatory Commission (NRC), and filed on behalf of numerous petitioners, has been referred to me pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Section 2.206. You request that the NRC immediately issue an Order suspending the Shearon Harris Nuclear Power Plant (SHNPP) operating license until SHNPP is in compliance with fire safety regulations. As the basis for your request, you discuss several fire safety violations at SHNPP which could affect the safe operation of the plant and safe shutdown of the plant in emergency situations. I would like to express my appreciation for your effort in bringing these matters to the attention of the NRC.The Petition Review Board (PRB) met on October 10, 2006, to discuss your request forimmmediate action to revoke SHNPP's operating license. The PRB denied your request for immediate action based on the staff's determination that there was no immediate threat to public health and safety. You were notified of this by phone on October 17, 2006.In a public meeting at NRC Headquarters on November 13, 2006, you met with the PRB topresent additional relevant information concerning your petition. The supplemental documents dated October 23 and 30, 2006, and submitted on October 23 and November 13, 2006, have been entered into the NRC's Agencywide Documents Access and Management System (ADAMS) under accession numbers ML062980107 and ML063200168, respectively. The results of that discussion and the supplemental documents have been considered in the PRB'sdetermination regarding your petition and in establishing the schedule for the review of your petition.After considering the petition request, and information provided at the public meeting, the PRBhas determined that your request does meet the criteria for acceptance as a 10 CFR 2.206 petition.
