Acceptance for Review of 2/02/10 Vogtle Application By letter dated February 2, 2010, (ML100340033), SNC submitted a request to revise the Technical Specifications (TS), Appendix A to Facility Operating License Numbers NPF-68 and NPF-81 for the Vogtle Electric Generating Plant Units 1 and 2, respectively. The changes would add Surveillance Requirement (SR) 3.3.1.15 to VEGP TS Table 3.3.1-1, "Reactor Trip System Instrumentation," Function 3, "Power Range Neutron Flux High Positive Rate." SR 3.3.1.15 requires verification that the RTS RESPONSE TIME is within limits every 18 months on a STAGGERED TEST BASIS. Function 3 is the Power Range Neutron Flux High Positive Rate Trip (PFRT) function. This change is being proposed based on a reanalysis of the Rod Cluster Control Assembly Bank Withdrawal at Power event. The purpose of this e-mail is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of this application. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the SNC's request in terms of regulatory requirements and the protection of public health and safety and the environment.

If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
