Based on the results of this inspection and the OI investigation, one apparent violation wasidentified and is being considered for escalated enforcement action in accordance with the NRC Enforcement Policy. The current Enforcement Policy is located on the NRC's Web site atwww.nrc.gov/reading-rm/adams.html; select What We Do, Enforcement, then EnforcementPolicy. Since the NRC has not made a final determination in this matter, no Notice of Violationis being issued for this inspection finding at this time. In addition, please be advised that thenumber and characterization of the apparent violations described in this inspection report may change as a result of further NRC review. Before the NRC makes its enforcement decision, we are providing you an opportunity to either: (1) respond to the AV's addressed in this letter within FPL 2 30 days of the date of this letter or request a pre-decisional enforcement conference. If aconference is held, it will not be open for public observation. Please contact Mr. Joel Munday, within 10 business days of the date of your receipt of this letter to notify us of your intentions. If we have not heard from you within 10 days, we will continue with our significance determination and enforcement decision and you will be advised by separate correspondence of the results of our deliberations on this matter.If you choose to provide a written response, it should clearly be marked as a "Response to (Apparent Violation) in Inspection Report No. 05000250/2006403, and 05000251/2006403 EA-06-176" and should include for each violation: (1) the reason for the apparent violation, or, if contested, the basis for disputing the apparent violation; (2) the corrective steps that have been taken and the results achieved; (3) the corrective steps that will be taken to avoid further violations; and (4) the date when full compliance will be achieved. Your response may reference or include previously docketed correspondence, if the correspondence adequately addresses the required response. If an adequate response is not received within the time specified or an extension of time has not been granted by the NRC, the NRC will proceed with its enforcement decision or schedule a pre-decisional enforcement conference.In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will beavailable electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). Dear Mr. Stall:

This refers to the Nuclear Regulatory Commission's (NRC) inspection completed onFebruary 24, 2006, at Florida Power and Light Company's (FPL) Turkey Point Nuclear Plant.

An Augmented Inspection Team (AIT) was established to examine activities conducted under your license as they relate to safety and compliance with the Commission's rules and regulations and with the conditions of your license. The results of the AIT inspection, which included security concerns at Turkey Point, were forwarded to you by our letter dated April 12, 2006. This report documents findings as a result of that inspection, and were discussed at an exit meeting on February 8, 2007, with Mr. T.
