As petitioners in the adjudicatory proceeding, we have been informed that this record has been redacted at the request of the Federal Energy Regulatory Commission (FERC). It is our understanding that the redactions remove information regarding the differing flood height to which the NRC previously required the Oconee reactors to be protected and the flood heights to which the NRC currently requires their protection.

Office of Nuclear Reactor Regulation Items of Interest Week Ending September 27, 2024 Notice of Enforcement Discretion (NOED) Verbal Approval for FitzPatrick Unit 1 On September 23, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff verbally approved a Notice of Enforcement Discretion (NOED) request for FitzPatrick Unit 1 to not enforce Technical Specification (TS) 3.3.2.1 Action C.2.1.2 for a one-time transition into Mode 2 from the current shutdown with an inoperable rod worth minimizer (RWM) until reaching 10%

power where the RWM is no longer required. The NOED will expire on September 25. This allows the licensee to proceed with startup and not perform the required TS action to verify by administrative methods that startup with RWM inoperable has not been performed in the current calendar year, since FitzPatrick previously conducted a startup during the current calendar year with an inoperable RWM.

Risk-Informed Decision-making (RIDM) 2.0 Workshops From September 24-26, 2024, the Office of Nuclear Reactor Regulation (NRR)s Risk-Informed Decision-making (RIDM) 2.0 Working Group, in partnership with the Be riskSMART and LIC-206 Teams, offered 4 workshops that were tailored to NRR and regional management and NRR technical staff, project managers and mission support corporate staff. The workshops featured examples of how we have applied risk informed decision-making to accomplish our safety mission and how we can build upon those accomplishments to enhance the use of RIDM.

Presenters also highlighted and demonstrated tools that staff could leverage to apply risk insights to their work. Representatives from other offices also attended the workshops.

Approximately 400 staff attended the workshops. Plans are underway to offer focused Knowledge Management / Knowledge Transfer sessions on risk topics and tools relevant to staff.

Public Meeting Related to the Reactor Oversight Process (ROP) to discuss: Advanced Act Section 507 On September 25, 2024, NRC staff hosted a public meeting related to the Reactor Oversight Process (ROP) to discuss: Advanced Act Section 507 Overview; next steps in the ongoing staff review of updates to NEI 99-02, Revision 8; the recent revision to IMC 0609 Appendix F, Fire Protection SDP (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML24241A154); and the results of the pilot for the proposed Emergency Response Facility and Equipment Readiness Performance Indicator. Attendees included representatives from NEI, the industry, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for November 20, 2024.

On September 24, 2024, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (89 FR 77769) to correct inadvertent errors in the regulatory instructions of the final rule that was published on August 30, 2024 (89 FR 70449). The correction is effective on September 30, 2024.

On September 27, 2024, the Office of the Federal Register published a notice in the Federal Register (89 FR 79125) correcting the comment period end date for an NRC direct rule that was published on September 5, 2024 (89 FR 72304). The direct final rule is effective November 19, 2024, unless significant adverse comments are received by October 7, 2024.

The purpose of this acquisition is to obtain technical assistance services to provide a thorough, current, and timely compilation of news stories along with an archive that is searchable by keyword and date in addition to a daily news briefing/summary of current news stories relevant to the agencys mission. The period of performance is from October 1, 2024, through September 30, 2025, with four option periods.

The total potential value of the contract can be up to $1,008,106.40.

Logistics and Support for Small Business Outreach Events On September 25, 2024, contract number 31310024C0027 was awarded to Strategix Management LLC in Washington, DC. The purpose of this contract is to procure logistics and support services for virtual and/or in person small business outreach events. The period of performance is from September 30, 2024, through September 29, 2027, with four option periods. The total potential value of the contract can be up to $921,265.87.

Update to Decommissioning Guidance in NUREG-1507 On September 20, 2024, contract number 31310024C0028 was awarded to SC&A Inc. in Arlington, VA. The purpose of this contract is to obtain guidance on a priori calculation of scan minimum detectable concentrations method for continuously collected data (i.e., radiological survey and location data collected without surveyor vigilance). The period of performance is from September 24, 2024, through September 23, 2025, with one option period. The total potential value of the contract can be up to $557,488.48.
