Items of Interest Week Ending MAY 1, 2020 Staff Issued Letter Regarding Exemptions to Specific Requirements in 10 CFR Part 20 Related to the COVID-19 Public Health Emergency On April 27, 2020, Directors from the Office of Nuclear Material Safety and Safeguards and the Office of Nuclear Reactor Regulation (NRR) issued a letter to industry (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20099G757) that summarizes the process for COVID-19-related Part 20 exemptions for all licensees. Specifically, the letter outlines the process for receiving expedited review of exemption requests from medical evaluation frequency and respirator fit-testing frequency requirements specified in Title 10 of the Code of Federal Regulations (10 CFR) 20.1703(c)(5)(iii) and 10 CFR 20.1703(c)(6).
Staff Hosted Public Meeting on Supplemental Guidance for Application of 10 CFR 50.59 to Digital Modifications On April 27, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting with the Nuclear Energy Institute (NEI) to provide clarification on staff developed comments on the guidance provided in NEI 96-07, Appendix D, Supplemental Guidance for Application of 10 CFR 50.59 to Digital Modifications (ADAMS Accession No. ML20114E196). The staffs next steps include presenting its endorsement of NEI 96-07, Appendix D, as documented in the draft regulatory guide (RG) 1.187, Revision 2, Guidance for Implementation of 10 CFR 50.59 Changes, Tests and Experiments, to the Advisory Committee on Reactor Safeguards and publishing the final RG 1.187, Revision 2 by summer 2020.
Staff Hosted Public Meeting on Backfitting On April 28, 2020, the NRC staff held a Category 3 public meeting via teleconference to discuss draft NUREG-1409, Backfitting Guidelines, which is available for public comment. The staff presented an overview of the draft NUREG and answered questions from the public. The staff also mentioned that the public comment period will be extended by 2 months in recognition of the impacts of the COVID-19 public health emergency.
Staff Reviewing Application of Common Q Digital Technology On April 28, 2020, the NRR staff accepted for review, WCAP-18461, Common Q Platform and Component Interface Module System Elimination of Technical Specification Surveillance Requirements (ADAMS Accession No. ML20070R094). This is the initial step in the evaluation of the Common Q digital technology to generically take credit for its digital self-diagnostics features and reduce associated instrumentation and control technical specification surveillances.
Staff Issued Draft Guidance for Changes During Construction for New Nuclear Power Plants Licensed Under 10 CFR Part 52 On April 28, 2020, the NRC staff issued Draft Guidance 1321, Guidance for Changes During Construction for New Nuclear Power Plants licensed under 10 CFR Part 52, for public comment; which, provides guidance on the 10 CFR 52.98(c) requirements regarding the

Staff Hosted Public Meeting on Fire Protection Requirements On April 29, 2020, the NRC staff held a Category 2 public meeting with NEI and nuclear power plant licensees to discuss fire protection requirements related to conducting drills as well as other licensing needs resulting from the COVID-19 public health emergency.
Staff Hosted Public Meeting on Fire Protection Requirements On April 30, 2020, the NRC staff held a Category 2 public meeting with NEI and the nuclear power plant licensees to discuss potential emergency preparedness enforcement guidance and temporary exemption requests resulting from the COVID-19 public health emergency.
Staff Issued Letter Regarding Exemptions to Specific Requirements in 10 CFR Part 74 Related to the COVID-19 Public Health Emergency On April 30, 2020, the NRC staff issued a letter to research and test reactor licensees that provides guidance for COVID-19 related exemptions from requirements to perform annual inventory of special nuclear material in accordance with 10 CFR Part 74 (ADAMS Accession No. ML20113F023). Additionally, the letter also provides guidance related to requests for extensions to schedules to submit associated required reports. Exemptions requested in accordance with this letter will receive expedited processing.
Staff Issued Letter Regarding Proposed SHINE Medical Isotope Production Facility On April 30, 2020, the NRC staff issued a letter (ADAMS Accession No. ML20114E315) to SHINE Medical Technologies, LLC (SHINE) providing a revised review schedule of 24 months for the operating license application. This schedule supports making a final determination whether an operating license should be issued to SHINE by October 2021. The proposed SHINE Medical Isotope Production Facility would be used for the production of medical radioisotopes, such as molybdenum-99. The NRC staff previously concluded that the SHINE operating license application was acceptable for docketing in October 2019.
Staff Issued Letter Regarding Proposed SHINE Medical Isotope Production Facility On May 1, 2020, the NRC staff issued a schedule letter to NuScale Power (NuScale) in order to communicate the status of the NRC staffs ongoing review of the Design Certification Application (ADAMS Accession No. ML20112F455). The schedule letter was initiated due to NuScales recent design changes related to boron redistribution within the reactor core. The letter states that the current milestone for Phase 5 (Advisory Committee on Reactor Safeguards Review of Advanced Safety Evaluation Report (SER) with No Open Items) will not be met, and that the staff will continue to re-evaluate the impact on Phase 6 (Final SER with No Open Items) as information is submitted by NuScale.
Staff Hosted Public Meeting to Discuss Insights from Risk-Informed Completion Time License Amendment Reviews On May 1, 2020, the NRR staff held a Category 2 public meeting with the industry to discuss recurring requests for additional information that had been issued as part of the staffs review of previous risk-informed completion time license amendment requests. The purpose of the
MAY 26, 2020 ENCLOSURE C meeting was to share lessons learned and provide information that could be included in the submittals to minimize requests for information in the future, thereby improving the efficiency of these reviews. The crediting of diverse and flexible coping strategies (i.e., post Fukushima mitigation) in probabilistic risk assessment models was of particular interest to the industry and this topic will be considered in upcoming regulatory audits and previously planned agency outreach efforts.
Staff Issued Closeout Letter Regarding Bulletin 2012-01, Design Vulnerability in Electric Power System On May 1, 2020, the NRC staff issued a combined closeout letter (ADAMS Accession No. ML20104A192) for Bulletin 2012-01, Design Vulnerability in Electric Power System, (Open Phase Condition) to all three Tennessee Valley Authority operating nuclear power plants. In addition to the closeout letter for the Seabrook Station (ADAMS Accession No. ML20071C899),
this marks the second closeout letter the staff has issued for Bulletin 2012-01.
Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. On April 30, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a direct final rule in the Federal Register (85 FR 23904) amending its spent fuel storage regulations by revising the Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 4 to Certificate of Compliance No. 1032. The companion proposed rule was also published on April 30, 2020 (85 FR 23923). The direct final rule is effective July 14, 2020, unless significant adverse comments are received by June 1, 2020.
Clarification of Personal Access Authorization Requirements for Non-Immigrant Foreign Nationals Working at Nuclear Power Plants: Draft Regulatory Issue Summary; Extension of Comment Period; 10 CFR Chapter I; NRC-2020-0073 On April 30, 2020, the NRC published a notice in the Federal Register (85 FR 23925) extending the comment period for a notice that was published on March 31, 2020 (85 FR 17770).
Comments were requested on a draft regulatory issue summary to reinforce the existing requirement that prior to granting or reinstating unescorted access, or certifying unescorted access authorization to non-immigrant foreign nationals for the purpose of performing work, licensees shall take reasonable steps to access reliable, independent sources of information, in addition to the information provided by the applicant, to verify the applicants claimed non-immigration status. The public comment period was originally scheduled to close on April 30, 2020. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments. Comments should be filed no later than June 15, 2020.
