The Nebraska Department of Water, Energy, and Environment (DWEE) has reviewed the above referenced plan. As with any project, permits may be required prior to beginning construction or operation.

Construction Storm Water/NPDES: If the project and/or supporting areas disturb more than one acre of soil (43,560 square feet), this project will need to obtain coverage under the Construction Storm Water General Permit NER210000. Additionally, if any pits need to be dewatered or groundwater lowered during construction, the site may need permitting under the Dewatering General Permit NEG671000. If the modifications to the OPPD Fort Calhoun Station facility change any characteristics
of the discharges under permit NE0000418 or ISW-202200961, please submit a request for modification or contact the NPDES section.
Dam Safety: No comments on this project.
Drinking Water: No comments on this project.
Floodplain Management: No comments on this project.
Geological Services: The amended ES did not specify the type of grout that will be used. The Department requests that NRC share the details of the type of grout proposed and the methods used for grouting prior to project initiation. If the grout and technique is appropriate, we will likely have no additional concerns.
Groundwater Wells: According to DWEE records, several registered groundwater wells are within the proposed project area. Care should be taken to locate and avoid impacting these wells. If the registration status, use, or ownership of a well changes due to the project, one or both of the following forms must be filed with DWEE: the water well registration modification form and/or the change of ownership form.
Additionally, the appropriate Natural Resources District (NRD), which may have additional rules and regulations regarding such changes, should be notified.
Remediation: The report references 2021 proposed DCGLs (derived concentration guideline levels),
currently approved DCGLs, and proposed DCGL revisions for certain parameters for groundwater impacts. The original proposal is not contained in the DWEE files, and the plan does not address groundwater impacts. The project will be required to comply with Nebraska Title 118 - Groundwater Quality Standards and Use Classification. The states antidegradation provision is stated in Ch. 3, § 001 and specific numerical standards are listed in Ch. 3, § 006 with consideration for background levels referenced in Ch. 3, § 007-008. Please note, in accordance with Ch. 2, § 001-002, the standards will be implemented in conjunction with other regulatory programs and [t]hese regulatory requirements will not preempt more stringent restrictions required of sources and facilities covered by state or federal statutes and regulations.
Stream Gaging: No comments on this project.
Surface Water Rights: Nebraska law provides that an appropriation not used for its beneficial purpose for more than five consecutive years may result in cancellation of the appropriation. Appropriation D-1100 was approved for cooling purposes only, if surface water is no longer needed for cooling purposes a relinquishment form should be submitted to DWEE.
Should surface water be needed for any other project related uses, then a new permit to appropriate water should be filed for that purpose.
Water Quality: The project may be required to comply with § 401 of the Clean Water Act of 1977, as amended by the Water Quality Act of 1987, and Nebraska Titles 120 and 117. If the project will result in a possible discharge of dredge and fill material into federally jurisdictional waters, a 404 Permit from US Army Corps of Engineers, 401 Water Quality Certification from DWEE, and compensatory mitigation may be required. It is recommended that during the project planning phase the applicant contact the Section 401 Program Coordinator at DWEE to discuss the project to ensure that it will comply with Nebraska Title 117 Water Quality Standards.
Waste Disposal: Waste Disposal: Nuclear Power Plant decommissioning, Demolition of site structures, construction of rail lines, containerization and shipping of radiological materials, generation and disposal of hazardous wastes, earth works, environment restoration - No Waste Permit Required. All waste generated or discovered on site must be properly handled, contained, and disposed as per all applicable regulations found in NE Title 128 - Nebraska Hazardous Waste Regulations and NE Title 132 - Integrated Solid Waste Management Regulations. This includes proper waste determinations and characterization before disposal. Where possible, DWEE urges reuse and recycling of any materials generated by the project.
