On May 12, 2025, NorthStar met with NRC staff via a TEAMS call to discuss submission of the Vallecitos Decommissioning Trust Fund for NRC review. Prior to the call, the NRC had expressed a need to review the trust fund Agreement, or Trust, established by the previous licensee in conjunction with the transfer of the NRC licenses associated with the Vallecitos Nuclear Center to NorthStar Vallecitos, LLC. For previous license transfers in which NorthStar was the recipient of the license(s), a Trust had already been established by the previous licensee, had been reviewed by the NRC and had been accepted by the NRC. Upon consummation of the license transfer, the transfer of trust assets (prepayment of funds) from the previous owner to NorthStar occurred. Consequently, NorthStar needed to take no further action. However, in this case, the previous licensee had been using surety bonds, not prepayment of funds in a Trust account, to demonstrate adequate decommissioning funding assurance; hence, consummation of the license transfer transaction resulted in the previous licensee depositing a prepayment sum into a NorthStar decommissioning account for Vallecitos Nuclear Center decommissioning activities. The NRC is seeking to verify that the decommissioning trust fund Agreement established as part of the license transfer, and as required of NorthStar's prepayment surety mechanism, adequately reflects NRC requirements for such a funding instrument (prepayment of funds).
