DESIGNATION OF THE AGENCYS FEDERAL PERSERVATION OFFICER This memorandum supersedes the memorandum issued on October 11, 2016 (Agencywide Documents Access and Management System Accession No.ML16242A132), which appointed and designated the Chair of the U.S. Nuclear Regulatory Commissions (NRCs) National Environmental Policy Act (NEPA) Executive Steering Committee as the agencys Federal Preservation Officer. In 2019, the Environmental Center of Expertise (ECOE) was established in the Division of Rulemaking, Environmental, and Financial Support (REFS) within the Office of Nuclear Material Safety and Safeguards (NMSS). The ECOE leads environmental reviews for the NRCs licensing actions as required by the NEPA, the Endangered Species Act, and the National Historic Preservation Act (NHPA) of 1966, as amended. The establishment of the ECOE eliminated the need for the NEPA Executive Steering Committee as all NEPA functions are in one NRC Office.
Section 110 of the NHPA, requires Federal agencies to designate a qualified official responsible for coordinating the Federal agencys activities in accordance with the NHPA (54 U.S.C.
306104). This official is known as the Federal Preservation Officer. As Executive Director for Operations of the NRC, pursuant to the Management Directive 9.17, Organization and Functions, Office of the Executive Director for Operations, I hereby appoint and designate the Director of NMSS/REFS as the agencys Federal Preservation Officer. I also delegate to the Federal Preservation Officer the authority to coordinate the agencys historic property preservation activities under 54 U.S.C. sections 300101-307108. This designation is effective immediately and shall remain in effect until revoked or superseded.
