Background===
On March 13, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff initiated consultation under Section 106 of the National Historic Preservation Act of 1966, as amended, with the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community regarding the Monticello Nuclear Generating Plant, Unit 1 (Monticello) subsequent license renewal application (Agencywide Documents Access and Management System ML23069A280). Over the course of the Section 106 consultation to date, our offices have held meetings to discuss this undertaking. During an October 24, 2024, teleconference, the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community requested a site visit to the Monticello site and that Xcel Energy (Xcel) update its fleet procedure to include notifications to the respective Tribes should ground disturbing activities occur and an invitation to monitor the activities.
NRC staff coordinated a site visit to the Monticello site to conduct a walkthrough of the Monticello site, review Xcel fleet procedures on the protection of cultural resources, and to continue dialogue and consultation with the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community.
Summary of Site Visit NRC staff conducted a limited walkthrough with the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community Tribal Historic Preservation Office (THPO) staff through a portion of the 2,000-acre Monticello site. After the walkthrough, Xcel provided the THPO staff a copy of the fleet procedure on the protection of cultural resources. The review of documents was followed by discussions between the NRC staff, THPO staff, and Xcel staff.
Xcel discussed that the fleet procedure stipulates that for projects where ground disturbance would occur in areas of higher potential for intact archaeological deposits, a Phase 1 survey will be conducted. A map that identifies the areas of high potential for intact archaeological deposits within the Monticello site was provided to the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community. The fleet procedure included a draft markup update that stipulates that for projects where ground disturbance would occur in areas of high potential for intact archaeological deposits within the Monticello 2,000-acre site, the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community will be notified and invited to monitor ground disturbing activities. The Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community found the fleet procedure and update to notify and invite their Tribes to monitor ground disturbing activities acceptable. The Lower Sioux Indian Community stated that they would review the fleet procedure in its entirety after the site visit and notify Xcel and the NRC staff if they have any comments on the procedure.
Xcel stated that they would finalize the fleet procedure to include the update that the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community will be notified and invited to monitor ground disturbing activities as written in the draft markup. The NRC staff requested that once Xcel finalized the fleet procedure update, to please notify the NRC via correspondence. The NRC staff discussed that it would draft a trip report of this site visit that will
be publicly available and that it is actively working on Record of Decision, which may include a reference to this meeting summary.
Action Items 1.) NRC staff will draft a trip report of the site visit and provide the trip report to the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community for review to ensure it adequately captures the site visit and discussions held prior to it being released to the public.
2.) Xcel will finalize the fleet procedure update to notify and invite the Lower Sioux Indian Community and the Shakopee Mdewakanton Sioux Community to monitor ground disturbing activities, as discussed above, and notify the NRC via correspondence that the fleet procedure update has been completed.
