The Nuclear Regulatory Commission (NRC) received your 10 CFR 2.206 Petition dated October 6, 2024, and initiated an immediate action assessment in accordance with Section II.A.2 of NRC Management Directive (MD) 8.11, Review Process for 10 CFR [Code of Federal Regulations] 2.206 Petitions (NRCs Agencywide Documents Access and Management System (ADAMS) Accession No. ML18296A043). In your petition, you requested that the NRC:
- 1) Issue an Executive Order requiring the immediate shutdown of all operational reactors at the Turkey Point and St. Lucie nuclear plants
- 2) Ensure that post-shutdown inspections are conducted
- 3) Mandate the enhancement of flood and storm surge defenses
The NRC staff concluded that the concerns expressed in your request regarding the approaching hurricane did not warrant immediate enforcement action.
NRC regulations require plants to be designed and constructed to robust standards that include consideration of site characteristics, including high winds and flooding.
NRC regulations also require nuclear power plant licensees to have in place comprehensive emergency planning programs (e.g., dedicated emergency response facilities, systems, equipment, and staffing). Detailed site-specific emergency plans and implementing procedures provide instructions and guidelines for dealing with or responding to a variety of emergency situations, including natural phenomena such as hurricanes.
The NRC closely monitors and responds to tropical storms and hurricanes as they approach the U.S. mainland - see https://www.nrc.gov/about-nrc/emerg-preparedness/respond-to-emerg/hurricane-response.html for details.
NRC resident and region-based inspectors were on-site to monitor the licensees storm preparation and to provide oversight during the storm. They had verified that both plants were prepared for the impact of the storm in accordance with each sites severe weather procedures that the NRC has reviewed and approved. If site conditions had warranted shutdown, each operating unit would have been shut down in accordance with approved procedures.
The NRC has screened your petition out of the 2.206 Petition Process consistent with MD 8.11 Section II.A.2(d)(ii), General Assertions and Duplicative Requests for Action under 10 CFR 2.206. The NRC has concluded that your request is a general assertion without supporting facts as it includes only general information about how the potential for significant rainfall, flooding, and a storm surge could jeopardize the safety of Turkey Point and St. Lucie nuclear plants but provides no specific storm
preparation inadequacy.
In addition,Section II.A.2.d(ii) of the NRCs Desktop Guide: Review Process for 10 CFR 2.206 Petitions (ML21237A347), which is linked on the NRCs public 10 CFR 2.206 website, includes the following text:
Examples of unsupported conclusory statements include a concern that an approaching weather condition will impact the safety or security of a facility with no other specific facts or a claim that the quality assurance program at a facility is inadequate with no further explanation.
