Dear Mr. Lashley:
By letter dated March 6, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23066A001), Energy Harbor Nuclear Corp. (Energy Harbor, the licensee) requested an alternative (RP-5) to certain requirements of the ASME OM Code at the Davis-Besse Nuclear Power Station, Unit No. 1 (Davis-Besse). Specifically, alternative RP-5 requested:
The performance periodic verification testing of the high pressure injection (HPI) pumps each refueling outage instead of biennially, and Changing the classification of the HPI pumps from Group B to Group A (referred to as Group AB for testing purposes) to include, in addition to other provisions, during the quarterly HPI pump test at Davis-Besse:
o vibration test requirements of ASME OM Code Paragraph ISTB-5121, and o vibration acceptance criteria of ASME OM Code Table ISTB-5121-1.
The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of the proposed alternative request. The acceptance review was performed to determine whether the scope and depth of the technical information was sufficient to allow the NRC staff to complete its detailed technical review. The acceptance review also intended to identify within the request any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing bases of the plant.
Pursuant to Section 50.55a(z)(2) of Title 10 of the Code of Federal Regulations, the applicant shall demonstrate that complying with the specified requirement would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety.
The NRC staff has reviewed Energy Harbors alternative request and concluded that it provided technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed alternative in terms of regulatory requirements. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.
Based on the information provided in Energy Harbors alternative request, the NRC staff has estimated that this request will take approximately 80 hours9.259259e-4 days <br />0.0222 hours <br />1.322751e-4 weeks <br />3.044e-5 months <br /> to complete and that the review can be completed by March 27, 2024. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during routine interactions between Energy Harbor and the NRC project
manager. These estimates are based on the NRC staffs initial review of the request and they could change due to several factors, including requests for additional information and unanticipated addition of scope to the review.
