Dear Mr. Wentworth,
The NRC staff is preparing its response to the subject license transfer application regarding the Palisades Nuclear Plant (Palisades) and Big Rock Point Plant (Big Rock Point) facility operating licenses. A brief description of the proposed action is provided below. Additional information can be found in the applicants submittal, which is also referenced below by ADAMS accession number.
The NRC has received the Petition of the Michigan Attorney General for Leave to Intervene and for a Hearing concerning the license transfer application (ADAMS Accession No. ML21055A888). The NRC staff is considering this submission, along with the public comments received during the Federal Register notice and comment period, in its review of the license
transfer application. Per the state consultation procedure, please let me know if you have any additional comments or questions on this proposed action by November 19th, if possible. The NRC staffs current projection for issuance of its decision on the proposed action is early December 2021. The date of this e-mail communication will be documented in the staffs associated safety evaluation.
Palisades Nuclear Plant and Big Rock Point Plant - Application for Order Consenting to Transfers of Licenses and Conforming License Amendments (EPID: L-2020-LLM-0003)
Application Date:
December 23, 2020 (ADAMS Accession No. ML20358A075), as supplemented by letters dated December 23, 2020, December 23, 2020, and October 29, 2021 (ADAMS Accession Nos.
ML20358A232, ML20358A239, and ML21302A064, respectively).
Brief Description of License Transfer Application:
Entergy Nuclear Operations, Inc. (ENOI), on behalf of itself; Entergy Nuclear Palisades, LLC (ENP); Holtec International (Holtec); and Holtec Decommissioning International, LLC (HDI)
(collectively, the Applicants), submitted Application for Order Consenting to Transfers of Control of Licenses and Approving Conforming License Amendments. Specifically, the application requested that the NRC consent to (1) the indirect transfer of control of Renewed Facility Operating License No. DPR 20 for Palisades, the general license for the Palisades independent spent fuel storage installation (ISFSI), Facility Operating License No. DPR 6 for Big Rock Point, and the general license for the Big Rock Point ISFSI (referred to collectively as the Sites and the licenses) to Holtec and (2) the transfer of ENOIs operating authority (i.e., its authority to conduct licensed activities at the Sites) to HDI. In addition, the Applicants requested that the NRC approve conforming administrative amendments to the licenses to reflect the proposed direct transfer of the licenses from ENOI to HDI and the planned name change from ENP to Holtec Palisades, LLC.

Notice of NRC consideration of the application was published in the Federal Register (FR) on February 4, 2021 (86 FR 8225) and included an opportunity to comment, request a hearing, and petition for leave to intervene. On February 24, 2021 (ADAMS Accession No. ML21055A888),
the State of Michigan filed a request for a hearing and a petition for leave to intervene challenging the proposed license transfers. Additional requests for hearing were filed by the Environmental Law and Policy Center (ADAMS Accession No. ML21055A914); and Beyond Nuclear, Michigan Safe Energy Future, and Dont Waste Michigan (ADAMS Accession No. ML21055A953). These requests are currently pending before the Commission.
