AMENDMENT 41 - APPROVAL OF TEMPORARY EXEMPTION FROM THE 2021 BIENNIAL EVALUATED EMERGENCY PLAN EXERCISE (ENTERPRISE PROJECT IDENTIFIER L-2021-EPR-0004)
Dear Mr. Terry:
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your letter dated September 14, 2021 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML21266A300), as supplemented by letter dated October 6, 2021 (ADAMS Accession No. ML21281A157), requesting an exemption from certain requirements of Title 10 of the Code of Federal Regulations (10 CFR), Paragraph 70.22(i)(3)(xii), Exercises. BWXT Nuclear Operations Group, Inc. - Lynchburg (BWXT NOG-L), requested a one-time exemption from the provisions of 10 CFR 70.22(i)(3)(xii), which requires a biennial evaluated emergency plan exercise.
NRC staff concludes that the postponement of the biennial evaluated emergency plan exercise is authorized by law, will not endanger life or property or the common defense and security, and is in the public interest. Materials License SNM-42 is hereby amended to add a license condition, number S-2(c) to reflect the exemption as follows:
The licensee is granted an exemption from performing the biennial emergency plan exercise listed in 10 CFR 70.22(i)(3)(xii) in calendar year 2021 but must complete said exercise within 35 months of the previously evaluated emergency plan exercise which occurred on October 30, 2019. Following that evaluated exercise, the licensee will conduct biennial emergency plan exercises in odd number years.
Additionally, the following license conditions are hereby deleted because they have expired:
S-1(a), issued per SNM-42 Amendment 38 (ADAMS Accession No. ML20181A109)
S-2(a), issued per SNM-42 Amendment 35 (ADAMS Accession No. ML20168B008)
S-2(b), issued per SNM-42 Amendment 37 (ADAMS Accession No. ML20177A212)
SG-6.9, issued per SNM-42 Amendment 31 (ADAMS Accession No. ML20093B963)
SG-6.10(a) & (b) issued per SNM-42 Amendment 33 (ADAMS Accession No. ML20107F694).
Documents transmitted by this letter contain Security-Related Information. When separated from Enclosure 2, this letter and Enclosure 3 are decontrolled.

OFFICIAL USE ONLY SECURITY-RELATED INFORMATION Each of the deleted license conditions was approved for an additional term per Amendment 40 (ADAMS Accession No. ML20356A024). Additionally, by letter dated July 21, 2021 (ADAMS Accession No. ML21209A957), BWXT NOG-L notified the NRC staff that it had revised the site emergency plan in a manner that did not reduce the effectiveness of the plan, meaning the changes did not require NRC pre-approval. Revision 34 of the site emergency plan, dated May 3, 2021, contains these changes. Consequently, the staff is updating license condition S-2 to refer to Revision 34 of the site emergency plan so that the license continues to refer to the applicable revision of the site emergency plan. All other license conditions shall remain the same.
Enclosures 1 and 2 to this letter provide the amended Materials License SNM-42. The NRC staffs review is documented in a Safety Evaluation Report, which is Enclosure 3 to this letter.
This letter concludes action on the referenced submittals, and Enterprise Project Identifier L-2021-EPR-0004 is considered CLOSED.
