image001.png image002.png Mr. McKenna:

I am contacting you to provide a status update on the petition for rulemaking you submitted to the U.S. Nuclear Regulatory Commission (NRC), dated June 1, 2020. In your petition, you requested that the NRC revise its regulations so that protective actions implemented during a General Emergency at a nuclear power plant will most likely do more good than harm when both the possible physical health effects of radiation exposure and protective actions are taken into consideration. The NRC docketed your letter as petition for rulemaking (PRM)-50-123, and the NRC published a notice of receipt in the Federal Register on August 31, 2020 (85 FR 53690). The status of PRM-50-123 can be found at the NRC Rules and Petition page at https://www.nrc.gov/reading-rm/doc-collections/rulemaking-ruleforum/active/PetitionIndex.html. At this Web site there is a link to a listing of all active NRC PRMs. You can monitor this site for status updates as they become available.

You can also continue to monitor the docket for PRM-50-123 at http://www.regulations.gov.

The Federal rulemaking Web site allows you to receive alerts when changes or additions occur in a docket folder. To subscribe: 1) navigate to the docket folder (NRC-2020-0155);

2) click the Sign up for E-mail Alerts link; and 3) enter your e-mail address and select how frequently you would like to receive e-mails (daily, weekly, or monthly).

Once the petition has been resolved, the NRC will publish a notice in the Federal Register explaining the NRCs finding. You will also receive a letter at that time notifying you of the action the NRC has taken.

Please contact me at Pamela.Noto@nrc.gov or (301) 415-6795 if you have any questions.

Sincerely,

Pamela Noto Project Manager NMSS/REFS 301-415-6795
