PROGRESS REPORT This progress report is prepared in response to the Licensing Board's "Merrorandtm and Order (Progress Report and Notice of Available Documents)"
dated June 6,
- 1986, and covers the period oe June 1, 1987 through July 31, 1987.

CONSTRUCTION PEFMITS On June 26, 1987, the U.S.
Court of Appeals for the District of Coltnbla Circuit issued its decision in the suit brought by the Citizen's Association for Sound Energy (CASE) against the Conmission, challenging the Conmiss ion's grant of an amendnent to Construction Permi t CPPR-126 for Comanche Peak Steam Electric Station (CPSES), Unit 1 after the latest construction carplet ion date
(" expiration" date) specified in the pern.it and before corrpleting a hearing.

Appeals. upheld the Conmission's decision to grant an extension of the CPSES, Unit 1' construction permit despite the Applicants' ~ failure to sutmit.a timely request for the extension.
The Atomic Safety and Licensing Appeal Board issued a decision on

June 30, 1987 resolving the Staff's and @plicants' first and second appeals in the CPSES, Unit 1 construction permit extension proceeding.-
The Appeal Board majority affirmed the Licensing Board's adnission of Anended Contention 2,
stating that the Consolidated Interveners had
. provided suf ficient. basis for the claims in the Anended Contention that
- Applicants had a
policy to deliberately ignore or violate bRC requirements, and that the policy had not been actually repudiated by the Applicants.
On July 17, 1987, Applicants petitioned the Conmission for review of the Appeal Board decision.
Canmission action on Applicant's request is pending.
The Applicants' April 29, 1987 request for an extension of the latest construction conpletion date of Construction Permit CPPR-127 for CPSES, Un i t 2 i s s t i l l unde r Sta f f cons idera t i on. At the Staf f's request, Aop!Icants provided additional information regarding groundwater withdrawal at the site, which was a condition in the original construction permit for lhit 2.

STAFF REVIEW Ato EFFORTS in a public meeting on July 29 and 30, 1987, in Dallas, Texas, the Applicants and Staff met to discuss the Applicants' June 25, 1987 response to the Staff's May 12, 1987 request for additional information on j
major ongoing programs and evaluations being implemented in support of CPSES licensing.
The Applicants described as part of their Corrective I

Action Program (CAP) the Post Construction Hardware Validation Program (IU NP).
The FONP is an expansion of the hardware validation efforts 8
previously described by the Applicants in their letter of October 16, 1986 to the Staff regarding pipe support installations.
According to Applicants, the FONP is intended to inplenent specific recarmendations of the Comanche Peak Response Team (CPRT), perform required inspections on hardware or engineering requironent modifications made in the course of the CAP, and perfonn hardware inspections as a result of new work.
The Staff is currently reviewing the information it obtained at the public meeting, and will determine what additional information is required to finalize a comprehensive review and inspection approach covering Ccmanche Peak iicensing activitles.
On July 22, 1987, Staff and Applicants discussed the status of licensing issues and interfaces with the CPRT/ CAP activities.
Staff and /pplicants identifled the following high priority items:

Staff review and evaluation of these matters is ongoing.
These issues were also discussed at the July 29-30, 1987 meeting.
The Staff acted on several licensing matters during this reporting.
period, issuing safety evaluation.s on the Applicants' commitments with regard to inpleentation of the revised General Design Criterion 4 in accordance with the Conmission's final rule of April 11, 1986 (51 FR 12502)', and on the Applicants' proposed methods for corrplying with item 2.2, Part 2 (vendor interface program for all safety-related corrponents) of Generic Letter 83-28, " Required Actions Based on Generic Implications of Salen AMS Events."
In early July the Staf f performed a scoping audit at the CPSES site of the Applicants' fire protection program implementation, and is currently making arrangements to perform a follow-up inspection in early fall of this year.
On June 2,1987, the Staf f and Applicants met to discuss the status of CPSES plant-specific steam generator tube rupture (SGTR) ana1ysis efforts (Meeting Surrmary dated June 17, 1987).
Staff provided specific guidance to Applicants on what the Staff needs in order to evaluate the CPSES plant-speci fic SGTR analysis.
The Staff discussed with the Applicants actions for resolution of TMi Action Plan (NJREG-0737)
Item II.D.1 regarding performance testing of relief and safety valves.
In the course of reviewing a sutmi ttal from the Applicants, on July 16 and 17, 1987, the Staff discussed with the Applicants and their contractors irrplemntation of Regulatory Guide 1.75,
" Physical independence of Electrica! Systans."
, i The Staff witnessed conduit clam testing conducted for the Applicants by NKD Engineers, Inc.,
Culver
- City, Cali fornia on June 23,, 1987.
E in order to develop a plan to review.the Applicants' design activities associated with their Corrective Action Programs, during this reporting period the Staff discussed with the Applicants and their contractors the status of these programs.
The Staff has tentatively scheduled a series of inspections and audits to be conducted at the Comanche Peak site and at the offices of the Appilcants' various contractors.
An initlai staff inspection of the design activities being conducted by Stone and Webster Engineering Corporation (SWEC) in the mechanical, civil / structural, electrical, and instrumentation and control areas is scheduled for August 1987 at SnEC's Boston, Massachusetts and site offices. Reviews and audits of the design activities associated with large and small bore piping and pipe supports (SWEC);
- heating, ventilation and air conditioning (HVAC) (Ebasco); and ceMult supports (Train C less than 2 inches) (Inpell) are also scheduled to conmence in August 1987.
The Staf f's review of cable trays and cable tray suppcrts, and conduit supports (Trains A and B and Train C greater than 2 1

(Ebasco and Inpell) is scheduled to conmence in the next reporting period.
During this reporting period, the Staff established an Allegation l
Review Cmmittee (ARC) which met on June 25 and July 15, 1987.

l ARC is charged with reviewing all new allegations (as of March 31, 1987) and specifying the course of action for their resolution.
The ARC will also establish a process to bring all allegations raised prior to March 31, 1987 to closure.

An enforcement conference (docunented in inspection Report 50-445/
8708) was held on July 6, 1987, to discuss two apparent violations docunented in inspection Report 50-445/8707; 50-446/8706.
The first violation concerned the late reporting under 10 C.F.R. 50.55(e) of the
)
excessive slope of the concrete floor under the 6.9KV switchgear.
That item was considered for escalated enforcement action.
The second item concerned the adequacy of nonconfonnance reporting procedures.
As of July 31, 1987, these items were still under consideration.
The unresolved item in inspection Report 50-445/8710; 50-446/8708 i
i concerns cooling fans being installed backwards in the auxiliary feed purp motors and the nonconfonnance not being reported per 10 C.F.R. 50.55(e) untii after the NRC raised the question of deportability.
Resolution of this unresolved item awaits the Applicants' determination whether the deficiency is reportable.
The Applicants have notified mC that the deficiency is potentially reportable and are performing an evaluation of the significance of the deficiency.

Starting In August 1987, this screening will be conpleted wIthin 30 days.
We Applicants have corrmitted ta screening all old ' nonconforming condit'lons for deportability within - the next four months.
Concerns. with control of system cleanliness discussed in Inspection Report. 50-445/8709; 50-446/8707.have been satisfactorily resolved as doctmented in inspection Report 50-445/8710; 50-446/8708..
Resolution included the Applicants' self-identification of shortcomings, stop work ce order, procedure revision, and preparation of a. cleanliness specification.
l On July 13, 1987, the onsite inspection staff met-with the Chief of the' Boll'er Division of the Texas' State Department of Labor and Standards and merrbers of his staff to discuss their responsibilities and activities at CPSES with regard to A9E Boller and' Pressure Vessel Code

On' June 25,.1987 the Director, Office of Special Projects, issued a 1
decision (DD-87-10 ) denying a " Request for Modification of Licenses" dated March 11, 1987 filed by Brazos Electric Cooperative, Inc. before the. Director, Office of Nuclear Reactor Regulation, pursuant to 10 C.F.R. 2.206.
The Conmission declined review of this denial and the decision became final agency action on July 20, 1987.
On July 20, 1987, David C.
Wililams, Director of-the Office of Special investigations of the General Accounting Office, began a special inquiry into three internal matters of concern to tEC and the Congress.
One of the matters upon which the inquiry is focusing is the adequacy of an Office of Inspector and Auditor investigation of allegations of staff misconduct involving the Comanche Peak project.
