FYI, I considered condensing the report given that there's not much going on. Ultimately, I decided to hold off circulating it until next month. I figured it could prove difficult to get concurrence with!(bJ(6>
l especially when new language tends to generate a lot of back and forth word-noodling. It's up to you if you want to update now or also hold off.

Request for Concurrence on Yucca Mountain Monthly Status Report - December 2018
Good morning, Attached, please find for your review the December Status Report on Activities Related to the Yucca Mountain Licensing Action to the Commission and to Congress. Also attached is the transmittal letter. This is being sent early because of the holidays and because the report will be due to the OEDO on January 2nd - the first day back after the New Year.
For those on the "To:" line or your designee, please review and provide concurrence bv COB on Monday. December 31. 2018. to allow time on January 2nd to assemble the transmittal package.
At this time there really isn't much to report, though we are watching the ongoing budget negotiations. Given the holidays and uncertainty with the budget negotiations, two options for the accomplishments section are provided. The appropriate one will be sent forward. If something more significant or unexpected occurs that is not captured by either option, the report will be resent for a quick turnaround concurrence. If that is necessary, expect the revised report the morning of January 2nd and due at noon.

Request for Concurrence on Yucca Mountain Monthly Status Report - March 2018 Importance: High Good morning, Attached, please find for your review the March Status Report on Activities Related to the Yucca Mountain Licensing Action to the Commission and to Congress. Also attached is the transmittal letter. Most of the updates focus on activities related to the LSNARP meeting.
Note that the March 5th drop-in with the Chairman requested by Nye County representatives was not included in the Stakeholder Communications and Interactions as that section has exclusively focused on staff activities. The report is due to the OEDO on 4/4, and SECY on 4/6.

the transmittal letter. This is being sent early because of the holidays and because the report will be due to the OEDO on January 2nd - the first day back after the New Year.
For those on the "To:" line or your designee, please review and provide concurrence by COB on Monday, December 31, 2018, to allow time on January 2nd to assemble the transmittal package.
At this time there really isn't much to report, though we are watching the ongoing budget negotiations. Given the holidays and uncertainty with the budget negotiations, two options for the accomplishments section are provided. The appropriate one will be sent forward. If something more significant or unexpected occurs that is not captured by either option, the report will be resent for a quick turnaround concurrence. If that is necessary, expect the revised report the morning of January 2nd and due at noon.

Renewals and Materials Branch Division of Spent Fuel Management Office of Nuclear Material Safety and Safeguards U.S. NUCLEAR REGULATORY COMMISSION STAFF TECHNICAL REPORT "DESCRIPTION OF CALCULATIONS TO SUPPORT NRC'S SUPPLEMENT TO THE YUCCA MOUNTAIN ENVIRONMENTAL IMPACT STATEMENT" The U.S. Department of Energy (DOE) submitted an Enviironmental Impact Statement (EIS) as part of the license application for a geologic repository for the disposal of spent nuclear fuel and high-level radioactive waste at Yucca Mountain, Nevada. During the preparation of the supplement to the EIS, the U.S. Nuclear Regulatory Commission (NRC) staff revised the EIS calculation package submitted by DOE. The staff verified DOE's implementation of contaminant transport equations and corrected parameters where needed. The staff also documented the revised calculation package in a technical report, titled "Description of Calculations to Support NRC's Supplement to the Yucca Mountain EIS" (see enclosure). The report documents the steps and procedures that NRC staff took to correct and revise DOE's calculation package, in order to provide additional detailed technical basis for the NRC staffs supplemental EIS. It is also documented for knowledge management purposes. The report will be made public in NRC's Agencywide Documents Access and Management System, ML17276B737, after the Office of Nuclear Material Safety and Safeguards' management and the Office of the General Counsel (OGC) concur.
The NRC staff, including the attorney from OGC, have finished the review and comments have been provided to the author. The author responded to all NRC staff comments on October 10, 2017.

Nevada v. NRC D.C. Circuit Jeremy Suttenberg This lawsuit challenges NRC's "Yucca Mountain Rule," 10 CFR Part 63, setting standards
( consistent with EP A's) for evaluating DO E's Yucca Mountain application. The court originally held the case in abeyance given DOE's motion to withdraw its Yucca Mountain application. ln the wake of the mandamus order in the Aiken County case, the court granted parties until February 24, 2014, to file motions concerning how the case should proceed. On that date, the parties requested that the court continue to hold the case in abeyance in light of the continued uncertainty concerning the resumption of the Yucca Mountain adjudicatory proceeding. The court granted the morion, and the case remains in abeyance. The parties have subsequently reported lo the,court that they are awaiting an agreement between the administration and Congress concerning appropriations for the Yucca Mountain licensing proceeding before recommending a course of action. If the case ever does move forward, it is likely to be heard in tandem with a pending lawsuit challenging EPA's "Yucca Mountain Rule."
Nevada v. NRC D.C. Circuit Andrew Averbach On July 2, 2018, Commissioner Wright denied the State of Nevada's request that he recuse himself from the Yucca Mountain licensing proceedings due to his prior involvement with the adjudication and public statements he had made concerning the project. On August 29, 20 l 8, Nevada filed a petition for review of this decision pursuant to the Nuclear Waste Policy Act. The NRC has moved to dismiss the petition, asserting that the only vehicle for seeking a Commissioner's recusal under the Nuclear Waste Policy Act is a petition for a writ of mandamus, and that Nevada has neither requested nor established a basis for mandamus relief. The motion is fully briefed and is pending before thecourt.
