Dear Mr. Aloisa:
During our telephone conversation of April 24, 2020, I requested that you provide me copies of letters (reports) provided to the NRC concerning your disposal of Electron Capture Detectors and a leaking sealed source (ECD). You requested that I provide you with references so that you would know what documents to provide which I am doing so as follows:
10 CFR31.5(c)(5) requires, in part, that a brief description of the event and the remedial action taken; and, in the case of the detection of 0.005 microcurie or more removable radioactive material likely to result in the contamination of the premises or the environs, a plan for ensuring that the premises and environs are acceptable for unrestricted use, must be furnished to the Director, Office of Nuclear Materials Safety and Safeguards, ATTN:
GLTS, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555-0001, within 30 days.
(I note that your leak test kit provider states that the report should be sent to the Regional Office, Inspection and Enforcement. The information is out-of-date.)
10 CFR 31.5(c)(8)(ii) requires, in part, that each licensee shall, within 30 days of the transfer of a device to a specific licensee, furnish a report to the Director, Office of Nuclear Materials Safety and Safeguards, ATTN: Document Control Desk/GLTS, using an appropriate method listed in 10 CFR 30.6. The report must contain the identification of the device by manufacturers (or initial transferors) name, model number and serial number; the name, address and license number of the person receiving the device; and the date of the transfer.
If you want to view the regulations in Part 20, 30 or 31 that pertain to you, then you can use any internet search engine and type in the regulation. For example, the Part 31 regulations for your program are all in 31.5 so you would type in 10 CFR 31.5 and then scroll to those of interest. 10 CFR 30.6 is referenced in one of the above and can be found by typing in 10 CFR 30.6.
