APPLICANTS' SUPPLEMENT TO APPLICANTS' ANSWER TO SAPL MOTION FOR RECONSIDERATION OF DENIAL OF SAPL SUPPLEMENTAL CONTENTION NO. 5 On February 10, 1984, the Intervenor Seacoast Anti-Pollution League (SAPL) filed a Motion for Reconsideration of Denial of SAPL Supplemental Contention No. 5.

The basis for the motion was the recent decision of the United States Court _of Appeals in New England Coalition on Nuclear Pollution v. NRC, F.2d No. 82-1581 (D.C. Cir.

7, 1984).

On February 24, 1984, the,1pplicant filed an answer to that motion advocating denial of the SAPL motion.

6 The Applicants took the position that the motion should be denied either because it was prematura or on the ground that no sufficient basis had been stated for the underlying contention.

In the section discussing prematurity, the Applicants noted that ".

the Commission may well put out written guidance on this matter."

App. Ans. at 5.

We have been advised that on February 27, 1984, the

-Commission indeed did issue a Policy Statemant which directed the Licensing Boards to continue to treat the rule excluding Financial Qualifications from consideration in individual licensing proceedings as valid.

CONCLUSION We respectfully submit that in light of the above-described Policy Statement of the Commission, the SAPL motion must be denied.
