On February 8, 1984, Applicants filed " Rebuttal Testimony of W.E.
- Baker, M.D. Muscente and M.N.
Bressler Regarding Allegations Involving AWS and ASME Code Provisions" in the above captioned proceeding.
On page two of that testimony Applicants noted that Mr. Bressler (who had assisted in developing and was to sponsor the testimony) was an employee of the Ter.nessee Valley Authority
("TVA"), a federal agency.
Further, Applicants stated that TVA.
had a policy of not allowing its employees to testify in NRC proceedings involving other licensees.
In deference to this policy, Applicants have elected not to subpoena Mr. Bressler, but instead to replace Mr. Bressler with two qualified experts, Messrs.
R.E.
Lorentz, Jr. and John D.
Stevenson.
Both Messrs. Lorentz and Stevenson have reviewed the testimony and will adopt it with the following minor changes:

Answer 4, page 6 (lines 4-6) of the previous testimony:
A clarification which notes that even where the AWS Code applies, a user may elect not to weld under the AWS prequalified procedures, but instead may qualify welding procedures by test.

Answer 15, page 17 of the previous testimony:
A clarification which notes that the lap joint requirements of subsection 8.8 of the AWS Code are applicable to building structures, and are the same as those in specified ASME Code sections.

Answer 16, page 18 (line 4) of the previous testimony:
l A clarification which notes that with regard to limitations on weld size, the ASME Code is either identical to or more stringent than applicable AWS Code provisions.

Answer 17, pages 19 (lines 10-22) and 20 (lines 5-13) of the previoas testimony:
The two new witnesses have not had an opportunity to confirm this information ( specific to CPSES) and, accordingly, it will be sponsored only by Mr. Baker and not the entire panel.
Revised rebuttal testimony incorporating these changes and including the qualifications of the two new sponsoring witnesses is attached hereto.
Applicants submit that there is good cause shown for this change, and that it will not prejudice any parties, or be disruptive to the hearing process.
On February 15, 1984, Applicants notified the Board and CASE of this change and Applicants are providing the revised testimony to all parties by hand delivery or federal express.
