Dear Mr. Novak:

r APS has recently announcH delays in the inservice dates for the PVNGS Units 1 and 2.

We now anticipate that Unit I will be ready to load fuel in August of 1983 and Unit 2 to load fuel in August of 1984 The current schedule for Unit 3 to load fuel in November of 1985 remains unchanged.

The PVNGS Construction Permit No. CPPR-141 for Unit No. I terminates in November of 1982, a request to amend this permit to reflect the current revision prior to the November 1982 des,!11ne will be provided in the future.

The record in the ASLB hearings was closed on June 25, 1982 and Applicants Proposed Findings of Fact and Conclusions of Law were submitted on July 26, 1982 as scheduled by the ASLB Chairman.

Intervenors Proposed Findings of Fact and Conclusion of Law are due to be filed on August 13, 1982 and those of NRC Staff on August 23, 1982. Applicants reply to Intervenors and Staff's proposal is due on August 30, 1982.

Supplement No. 2 of the SER was issued in May 1982 and we are continuing to work with the NRC staff in resolving those items in which further clarification or interpretation is requried. We appreciate the dedication to which the NRC staff has displayed in their review of PVNGS and hope to continue the working relationship that has existed during this review.

Arizona Public Service Company (APS), as Project Manager of the Palo Verde Nuclear Generating Station (PVNGS), is enclosing herewith three (3) ori.31nals and nineteen copies of its Request for Extension of the Latest Completion Date for Construction Permit No. CPPR-141, dated May 12, 1983.

The enclosed Request seeks the extension of the latest date for completion of construction of Palo Verde Unit 1 from Auguot 31, 1983, to December 31, 1983.

We request this extension even though we fully anticipate PVNGS Unit I should be prepared to load fuel earlier.

Pursuant to 10CFR p170.22, APS is submitting herewith its check in the amount of $1,200 in payment of the filing fee associated with Class II amendment.

CPPR-141 Pursuant to 10 CFR 550.90, Arizona Public Service Company (APS), Salt River Project Agricultural Improvement and Power District (SRP), El Paso Electric Conpany (EPE), Southern California Edison Company (SCE), Public Service Company of New Mexico (PNM), and Southern California Power Authority (SCPPA)

(herein after collectively referred to as " Joint Applicants")

submit herewith this " Request for Extension of the Latest Completion Date for Construction Permit No. CPPR-141."

This Request, pursuant to 10 CFR S50.55(b), seeks an extension of the latest date for completion of construction of Unit 1 of the Palo Verde Nuclear Generating Station (PVNGS) from August 31, 1983, to December 31, 1983.

In support of this Request, APS states as follows:

I.

Extension of Latest Day for Completion of Unit 1.

1.

On May 25, 1976, the Nuclear Regulatory Commission

issued a permit to construct PVNGS Unit 1 (CPPR-141).

Paragraph 3A of such permit specified the latest date for completion to be November 1, 1982.

By an Order issued on November 4, 1982, the Commission extended the latest completion dcte for CPPR-141 from November 1, 1982, to August 31, 1983, as requested by APS in its letter dated October 12, 1982.

It now appears unlikely that PVNGS Unit 1 can be made ready for fuel loading by August 31, 1983, even though we are making every effort to do so in a manner consistent with APS' dedication to design and construct a safe and reliable unit which meets the commitments made in the PVNGS Final Safety Analysis Report (FSAR) and the requirements of the NRC.

The delay in completion of Palo Verde Unit 1 beyond August 31, 1983, is likely due to the following factors:

A.

Late delivery cf certain electrical instru-mentation and control equipment; B.

Changes and additions to the PVNGS design required to meet NUREG-0737 requirements and other changes in regulatory requirements necessary for an operating license have introduced complexities which-have impacted and delayed preoperational testing and the transition from the construction phase to the start-up phase.

The extension of the latest completion date for the construction of Unit 1 does not present an unreviewed environmental impact.

Pursuant to 10 CFR 551.5(d) (4), no environmental impact statement, negative declaration, or environmental impact appraisal need be prepared in connection with such extension.

5.

The extension of the latest completion date for the construction of Unit 1 does not involve a significant hazards consideration and is not inimical to the common defense and security or to the health and safety of the public..

LiHEREFORE, Joint Applicants request that Paragraph 3A of Construction Permit No. CPPR-141 be amended by order of the

!!uclear Regulatory Commission to provide that the latest date for completion of Palo Verde Unit 1 is December 31, 1983.
