ENCLOSURE 1 NOTICE OF VIOLATION Westinghouse Electric Corporation Docket No. 70-1151 Commerical Nuclear Fuel Division License No. SNM-Il07 During an NRC inspection conducted on October 25-29,-1993, a violation of NRC requirements was identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C the violation is listed below:
10 CFR 71.5(a) requires each licensee who transports licensed material outside the confines of its plant or other place of use, or who delivers licensed material to a carrier for transport, to comply with the applicable requirements of the regulations appropriate to the mode of transport of the Department of Transportation (DOT) in 49 CFR Parts 170-189.
49 CFR 172.201(c) requires shipping papers consisting of more than one page to be consecutively numbered and the first page to bear a notation specifying the total number of pages included in the shipping paper.
49 CFR 172.201(d) requires, in part, that shipping papers must contain an emergency response telephone number, as prescribed in subpart.G of part 172 of this subchapter.
49 CFR 172.203(c)(2) requires, in part, that the letters "RQ" be entered on the shipping paper either before or after the basic description required by section (9) 172.202 for reportable quantities of hazardous substance as defined in 49 CFR 171.8 and listed in Column 3 of the Appendix to 6172.101.
49 CFR 172.203(d)(vi) requires, in part, that shipping papers for a consignment of fissile radioactive materials include the words " Fissile Exempt," if the package is exempt from the requirements of 49 CFR 173.451-459 pursuant to 9173.453 of the subchapter.
Contrary to the above, the licensee failed to meet requirementi for DOT-shipping paper discriptions in that:

Selected shipping paper descriptions required by 49-CFR 172.201-205 for seven Low Level Radioactive Waste (LLRW) consignments shipped between May 13 and September 14, 1993, were not listed on consecutively numbered pages nor were the correct total number of pages containing all the required information notated.
(2)
Shipping papers for an August 3, 1993 LLRW consignment did not include an emergency response telephone number.

Shipping paper descriptions for seven LLRW consignments shipped between May 13 and September 14, 1993, were listed improperly as having reportable quantities. (RQ) of radioactive materials beforeL the basic description required by 9172.202.

Shipping paper descriptions for seven shipments of LLRW shipped-between May 13, 1993 and September _14, 1993, which included packages containing fissile material exempted from the requirements of 49 CFR 173.451-459 in accordance with 9173.453, did not include the additional description of _the hazardous material as " Fissile Exempt."
These examples are considered collectively as a Severity Level IV violation (Supplement V).
Pursuant to the provisions of 10 CFR 2.201, Westinghouse Electric Corporation is hereby required to submit a written statement or explanation to the U.S.
Nuclear Regulatory Commission,- ATTN: Document Control Desk, Washington,~ D.C.
20555 with a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting.this Notice of Violation (Notice)..This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this Notice, an order or Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause.
