Response to NRC Bulletin 88-10, Supplement 1: Nonconforming Molded Case Circuit Breakers Gentlemen:

-On August 11, 1989, New Hampshire Yankee (NHY) provided an updated report (Reference (c)) describing actions taken in response to NRC Bulletin 88-10 to provide reasonable assurance that Class 1E molded case circuit breakers (MCCBs) in-inventory or installed in safety-related. applications at Seabrook Station were traceable _to a circuit breaker manufacturer (CBM). In that report, NHY described the disposition of MCCBs which had been identified in accordance with-the criteria of NRC Bulletin 88-10, not including Supplement 1.

This lett3r reports the results of the review performed in response to Supplement 1 of the Bulletin'.

Supplement 1 to NRC Bulletin 88-10 provided clarifications to the basic l

Bulletin and requested licensees to verify that responses met the Bulletin pr.ovisions as clarified by Supplement 1.

New Hampshire Yankee has verified

.that actions described in Reference (c) were fully responsive to NRC Bulletin 88-10 as clarified by Supplement 1 except that NRC Position 1 of Supplement 1 increased the scope of the basic Bulletin and requested additional action as described below.

L In response to NRC Position 1 of Supplement 1, NHY reviewed construction-related procurement records for MCCBs. That review determined that 307 MCCBs, in addition to thoee identified within the scope of the initial response to the Bulletin, had been purchased by United Engineers and Constructors (UEfrC) and

were purchased from Telemecaniquo or its predecessor companies, and the remaining two were purchased from Westinghouse Electric Company.

q New Hampshire Yankee has verified that Certificates cf Conformance were q

issued by Telemecanique for all 305 Telemecanique-supplied MCCBs and that I

documentation exists in the possession of either Telemecanique or NHY estab-l' liehing traceability to the CBM of 171 of the 305 MCCBs.

The Telemecanique documentation was verified by means of a vendor surveillance, performed by NHY, on the premises of Telemecanique Inc., Westminster, Maryland. However, docu-mentation has not been located either within NHY records or at Telemecanique to complete the traceability link between Telemecanique and the CBM for 134 of the 305 Telemecanique-supplied MCCBs.

It is NHY's position that, independent of

_l such documentation, there is reasonable assurance that Telemecanique or its j

predecessor companies purchased all MCCBs directly from the CBM.

New Hampshire Yankee has been informed in writing by Telemecanique that all MCCBs supplied to Seabrook Station by Telemecanique, either contained in or provided as spare or replacement parts for Class 1E qualified equipment, were obtained by Teleme-canique directly from the original circuit breaker manufacturer.

The NRC performed an inspection of-the Telemecanique facility at West-minster, Md., in December 1988. In the inspection report (Report No.

99901011/88-01), the NRC stated that '(n]o instance of Telemecanique procuring i

breakers from distributors or from other than Siemens was noted during the inspection.'

Siemens is the CBM.

The NRC also stated in the inspection report

)

that they reviewed a list of all Telemecanique suppliers dating back to 1985 and did not find any companies suspected of supplying potentially defective, refurbished equipment.

The NRC further noted that all circuit breakers to be dedicated for safety-related applications by Telemecanique were subjected to an overload test, a continuity check and a mechanical check.

Such tests and checks verify the capability of Telemecanique-supplied MCCBs to perform their required j

function.

l Two MCCBs identified in response to Supplement 1 of the Bulletin were supplied by Westinghouse Nuclear Service Integration Division (NSID).

Hampshire Yankee has been informed in writing by Westinghouse that these two l

MCCBs were manufactured and supplied by a Westinghouse division.

On this basis, 1

NHY has concluded that these two MCCBs are traceable to the CBM.

Y Based upon the above information, NHY concludes there is reasonable assurance that, at the time of installation, MCCBs from the above-discussed group of 307 MCCBs which were installed in safsty-related applications at Seabrook Station were new and not refurbished or otherwise suspect.
