Dear Mr. Marshall:

This is in response to your letter of Decenber 14, 1981 in which you (1) asked why the potential effects of electromagnetic pulse (EMP) on nuclear power plants was not considered an Unresolved Safety Issue, and (2) reiter-ated your request (first stated in your mailgram of October 1,1981) that construction of the Midland Plant be suspended pending resolution of the EMP issue.

The Enclosure (SECY-81-641, November 5,1981), a report which was prepared by the staff for the Comission, addresses the background, status and projected completion of the ongoing NRC investigation of the effects of EMP on nuclear power plants. The essential elements of this report were included in our letter to you d u ed November 24, 1981 in response to your mailgram; however, the enclosed report itself will provide you with more detailed information on this subject.

Your concern that the effects of EMP on nuclear power plants has not been formally designated an Unresolved Safety Issue is a pmcedural rather than a substantive one. The fact is that an intensive, methodical, and thorough investigation of this issue has been underway since mid 1979. We believe the results of this investigation will provide the valid technical basis necessary for either the reaffirmation or the amendment of the prasent

- Regulations (10 CFR 50.13) regarding EMP. In this regard, please acte the measures being taken as cited in the Enclosure for assuring the technical validity of the results of the investigation.

A final report on the EMP investigation will be issued, probably in August 1982. The Comission will then decide on its relevance and application in the nuclear regulatory process.

If this results in revisions to the regulations in regard to improved EMP protection, Midland, like other nuclear plants, would be considered in the implementation planning of the regulations.
