APPLICANTS' ANSWER TO INTERVENORS8 MOTION FOR EXTENSION OF TIME TO FILE AN APPLICATION FOR A STAY OF LBP-89-28 Under date of November 17, 1989, The Attorney General of The Commonwealth of Massachusetts (MAG) on behalf of himself and New England Coalition on Nuclear Pollution (NECNP) and Seacoast Anti-Pollution League (SAPL), filed a " Motion for Extension of Time to File an Application for Stay of LBP-89-28" ("the Motion").

The thrust of.the Motion is to seek an extension of tim'e to November 30, 1989 for the filing of a motion seeking a stay of the Licensing Board's decision in LBP-89-28, which was rendered and served on October 12, 1989.

For the reasons set forth below, the Applicants say that the Motion should be denied.

The motion proceeds from the erroneous premise =that there is extant a time period for seeking a stay of LBP-89-28 apparently EX28MORI.58 e

I on the theory that the allowed 10 day time period for seeking a stay under 10 CFR $ 2.788 began to run from November 13, 1989.

This simply is not the law.

The rule is that:

i "Within ten-(10) days after service of a

.a decision or action any party to the proceeding may file an application for a stay L

of the effectiveness of the decision or action pending filing of and a decision on an appeal or petition for review."

10 CFR S 2.7S0(a) (emphases supplied).

The concept of finality for appeal purposes plays no part in the filing and consideration of a stay petition.

A stay may be i

sought of any action, interlocutory or otherwise; that is why the draftsmen of the regulation included the word " action."

In addition that is why the language of the regulation contemplates that the stay motion may be filed in advance of an actual filing of'a Notice of Appeal or Petition for Review.

Because there is no application period still open and running to extend, the Motion should be denied.
