Dear Mr. Grier:
With reference to the inspecticn conducted by Mr. T. Stetka of your office on February 4 through 8 and 15,1980 at the James A.
FitzPatrick Nuclear Power Plant, and in accordance with the provisions of Section 2.201 of Part II of Title 10 of the Code of Federal Regula-tions, we are submitting our response to Appendix A Notice of Violation transmitted by your letter dated March 11, 1980 as received by the undersigned on March 17, 1980.
APPENDIX A NOTICE OF VIOLATION Based on the results of an NRC inspection conducted on February 4-8 and 15, 1980, it appears that certain of your activities were not conducted in full compliance with condidtions of your NRC Facility License No. DPR-59, as indicated below.
Item A is an infraction and Item B is a deficiency.
A.
Technical Specification 3.3A.2a states in part; " Control rods which cannot be moved with control rod drive pressure shall be considered inoperable."
l Technical Specification 4.3A.2.d states in part; "If the a control rod cannot be fully inserted, a shutdown margin test shall be made to demonstrate under this condition that the core can be made sub-critical for any reactivity condition during the remainder of the operating cycle with the analytically determined, highest worth control rod capable of withdrawal, fully withdrawn, and all other control rods capable of insertion fully inserted."

I&E INSPECTION N0. 80-01 Page Contrary to the above, on November 5,1979 at 0900 hours0.0104 days <br />0.25 hours <br />0.00149 weeks <br />3.4245e-4 months <br />, partially inserted control rod 18-35 was isolated and made inoperable, to repair a leak on the hydraulic control unit, without either fully inserting the control rod or performing a shutdown margin test prior to making the control rod inoperable.
B.
Environmental Technical Specification 2.2.3 states in part; "The pH of treated water in the waste neutralizer tanks and floor drain sample tanks prior to being discharged into the discharge tunnel shall be between 6.0 and 9.0" Contrary to the above, during the period of December 9,1979 through January 2,1980, an uncontrolled release of regeneration waste water with an estimated pH range of 4.0 to 9.1 was discharged into the discharge tunnel.
RESPONSE TO ITEM A The FitzPatrick Plant staff acknowledges the failure to perform a shut-down margin test as required by Technical Specifications Paragraph 4.3.A.2.d.
Corrective action to prevent future items of non-compliance has been taken. This action included discussions with the Operations Superintendent and the Shift Supervisor on duty at the time of the event..In addition, a copy of this letter of response will be included in the licensed operator training program.
Full compliance has been achieved.
RESPONSE TO ITEM B The FitzPatrick Plant acknowledged the item of non-compliance with respect to Environmental Technical Specifications Paragraph 2.2.3 as part of its submission of LER 80-002 to your office.
The referenced LER and a subsequent Revision on February 12, 1980, indicated that the Operating Pro-cedure associated with operation of the makeup system waste neutralizer tanks would be revised to require verification of proper drain valve position prior to the start of any activity which could result in the release of untreated and/or unmonitored chemical wastes if the drain valve lineup was improper.
This action was completed and reviewed by the Plant Operations Review Committee at Meeting No.80-011 on February 22, 1980.
In addition, the event has been discussed with personnel operating the system to preclude re-currence. These actions have resulted in operation of the system within full compliance of the Technical Specifications.
