Dear Mr. Grier:
With reference to the inspection conducted by Mr. L. H. Thonus of your office on December 12 through 14, 1979 at the James A. FitzPatrick Nuclear Power Plant, and in accordance with the provisions of Section 2.201 of Part II of Title 10 of the Code of Federal Regulations, we are submitting our response to Appendix A Notice of Violation transmitted by your letter dated February 15, 1980 as received by the undersigned on February 21, 1980.
APPENDIX A NOTICE OF VIOLATION Based on the results of an NRC inspection conducted on December 12-14, 1979, it appears that one of your activities was not conducted in full compliance with NRC regulations and the conditions of your license as indicated below, i

10 CFR 50, Appendix B, Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants, Criterion II, " Quality Assurance Program,"
states, in part, "The applicant shall establish...a quality assurance program which complies with the requirements of this appendix... the program shall provide for indoctrination and training of personnel..."

Docket No. 50-333 I & E Inspection No. 79-18 Page The licensee's accepted Quality Assurance Program states in Section II, Subsection 2.8, that, " Education and training at the plant shall be pro-vided for personnel engaged in activities affecting quality, as necessary, for the purpose of achieving and maintaining a suitable level of pro-ficiency in their respective functions.
The training program shall be applicable to both headquarters and plant personnel... A training procedure shall be established which will include provisions to implement an' adequate training program and shall include provisions for maintaining training records which indicate such items as identification of specific training function, personnel in attendance, date of training and instructor."
The Licensee's " Indoctrination and Training Procedure #3, General Employee Training," Revision 0, dated October 28, 1977, requires, in part, in Section 3.5.6, " General Employee Training," that, " Plant personnel qualified in radiation protection shall be provided with annual retraining."
Contrary to the above requirements, on December 13, 1979, two individuals had not received annual retraining in radiation protection.
One individual had exceeded the annual retraining interval by 6 months and the other by 10 months.
RESPONSE TO NOTICE OF VIOLATION The FitzPatrick Plant staff acknowledges the item of non-compliance cited above.
The two individuals of concern received the annual retraining in radiation protection as required by Indoctrination and Training Procedure
- 3 (ITP#3) during December 1979, thus bringing the plant staff into full compliance.
A review of administrative controls relating to the retraining require-ments has been conducted. While this review indicates that the mechanism to alert supervisors or the training coordinator of the need to conduct retraining already exists, some clarification or strengthening of the procedures is desirable. Accordingly, ITP#3 will be revised by June of 1980 to clearly specify the method by which individuals or the individuals' supervisor will be notified of retraining requirements and to require that the supervisor schedule the individual for retraining within the required time frame.
This action should prevent recurrence.
