AEC REGULATORY STAFF'S ANSWER TO OBJECTION TO CONSTRUCTION OF THE JUNIATA TRANSMISSION LINE AND REQUEST FOR HEARING fit.ED BY CITIZENS FOR A SAFE ENVIRCNMENT AND THE ENVIRCNMENTAL COALITION ON NUCLEAR POWER 1.

On April 10, 1973, the United States Atomic Energy Commission published a Determination to Rescind Suspension of Construction Activities concerning the Three Mile Island Nuclear Station, Units 1 and 2 (38 FR 9105). That notice provided that any person whose interest may be affected by the proceeding may file a request for a hearing and that such request shall set forth the factual basis for the request.

On May 2,1973, pursuant to the foregoing Federal Register notice, Citizens for a Safe Environment and the Environmental Coalition on Nuclear Pcwer (hereinafter referred to as "the petitioners" or "the Coalition") filed a timely petition to intervene and a request for a public nearing in tne case.

The regulatory staff believes that the petition to intervene should be rejected. Petitioners contend that an irretrievable comitment of substantial resources and expenditures will be made for construction of the lina, and alleges that the ultimate decision - in the context of the cost / benefit analysis to be considered in the forthc6 ming Three Mile Island operating license proceeding - would be adversely affected.

Peti tioners,

however, fail to present any factual basis to support their allegation.

In the Amended Discussion and Findings by the Directorate of Reactor Licensing dated December 9,.1972, it was stated at page 4 that the transmission line in question is estimated to cost approximately $2,000,000, while the total cost of the Three Mile Island Station is estimated to bA $780 millicn, of which $402 million has already been spent or commi tted.

It was concluded, in meeting the guidelines set forth in Coalition for Safe Nuclear Pcwg v. U. S. Atomic Eneray Comission, 463 F.2d 954 (1972), that these expendi-tures are insignificant in comparison to the funds already spent or comitted for the plant as a whole and would not influence any decisions regarding the plant based on the full NEPA review. As indicated above, petitioners have not presented a factual basis in support of their positien, and 63-153

as a consequence they have not set forth, as required oy the April 10, notice, any matters wnicn would tend to warrant a determination other than that made by the Director of Regulatica. The request for a hearing, therefore, should be denied.
