The regulatlon, 10 CFR 5@.5rl(w), requires that each commercial power reactor llsensee shall, by June 23. 198:!,

The ltcensee tndlcated that I t would bbtatn priniary property tnsurance covertng dariges up to $450 mtll ton (srbseqJently tncreasetl by the carrier to $500 millton) but that it did not belgeve that coverage i n excess of $500 mtllion was justifted at tlits tiw. In revlewtng Consumers exemptton request, the staff determtned that addtttonal tnformatlon was required.
Thts tnformation was soltcttt!d by letter t o the ltcensee dated July 12, 1982.
The ltcensee has responded to t h t s request by letter dated August 10, 1982.
Because of the addittonal information provided by the ltcensee i n its August 10th letter, the Comntssion t!; able t o conslder the exemptton request on tts merits.
Both I n Ots study and its response to staffs questions, Cmsumers Power has postulated a maxtmum credtble accident whtch results i n releases o f 100% of the noble gdses, 100% of the todines, 1%
o f the cesiums and about 105 o f tlie other solids. The licensee states, This release fraction i s conslstent wtth rlASH-1400 (Appendix V,
Table V2-11, where the worst case (PWR-1) resulted I n a release of 90%
of the noble gases, 70% of the halogcnt, 40% of the cesiums and 0-405

This report considers three accident scenarios with a THI-2 type accident consfdered t o be o f fntenedfdte severity.
Thfs information indicates t h a t although there i s srme relationship between size o f a reactor and accident cleanup costs, certain o f the major costs tnvolved with accident cleanup -- such as defueltng a damaged reactor, a c t t v t t i e s t o maintain a f a c t l t t y In c o l d shutdortn, and constructton o f new treadnenr f a c i l t t i e s -- are not s t r i c t l y poHer level dependent.
The 1tcen:ee has indicated lower expected costs overall f o r cleanup o f Big Rock P d r t because o f Its-small size.
- However, it has correctly indicated those steps i n the cleanup process, as used I n the examples above, m e r e cost i s n o t directly related t o core stre.

Whon such excess lnsurance or protectton is not required to cover the costs o f cleanup o f a maximum credible acr'4ent. the NRC staff agrees wlth the llcensee's sssessmant that the cost of fuch Insurance or protection i s too burdensow, In sum, the Comnlssion belteves that the ltcensee has provlded adequate justification for being exempted from the excess Insurance requirements of 10 CFR 50.54(w)(l)(il). hlthough the Comnissian's Informatlon base on the relatton between reactor size and acct dent decontamination cost has not yet been completed, sufftclent tnformation exists to determine t h, t decontamlnatlon and cleanup costs occurring as a result of an accident a t a reactor o f Big Rock Putnt's small slte wouid, w i t h a reasonable degree of assurance. be covered by $500 mtllion insurance. The licensee continues to be requlred to mainta6n, a t a minium, total primary insuranCp coverage or equivalent protection offered by ANI and MAERP jo:ntly or NiU pursuant to 10 CFR 50.54(w)(l)(i).
