Background
- Under 10 CFR 50.55a facilities licensed under Part 52 are subject to Section III of the ASME Code prior to the 52.103(g) finding. Following the 52.103 (g) finding, the licensee is subject to ASME Section XI.
- ASME Section III requires a hydrostatic test following performance of a repair and/or replacement activity associated with a Class 1, 2, or 3 pressure boundary.
- The requirement to conduct multiple hydros at the elevated pressures required by ASME Section III following repair/replacement activities prior to the Section 52.103(g) finding creates a hardship associated with establishing test boundaries and elevated pressure.

Regulatory Considerations
- Consideration was given to an Exemption to 10 CFR 50.55a and an alternative in accordance with 10 CFR 50.55a(z)
- Both paths would present a similar hardship argument
- Pursuing the alternative path in accordance with 10 CFR 50.55a(z)
- 10 CFR 50.55a(z) allows NRC staff to authorize the use of alternative requirements to ASME Section III requirements.
Consideration was given to NRC recommendations presented in 2009 during interface with utilities [ADAM Accession # ML092310072, slide 8].
Application of ASME Section III up to the 52.103(g) finding presents a hardship due to the potential for multiples cycles of establishing test boundaries, establishing elevated pressures, and putting additional stress cycles on system beyond design pressure.
