STATUS UPDATE REGARDING THE ENVIRONMENTAL REVIEW FOR THE PROPOSED TURKEY POINT UNITS 6 AND 7 COMBINED LICENSE APPLICATION

Dear Mr. Thrower:

This letter provides a status update on the U.S. Nuclear Regulatory Commissions (NRC) staff and U.S. Army Corps of Engineers (USACE) environmental review for the Florida Power and Light Company (FPL) combined license (COL) application for the construction and operation of two new nuclear power plants (Units 6 and 7) at its Turkey Point site near Homestead, Florida.

The last communication from the NRC staff and USACE to the Poarch Band of Creek Indians was in June 2010 (Enclosure 1). In that correspondence, the staff was seeking input on historic properties as part of the National Environmental Policy Act (NEPA) scoping process for the proposed units as well as providing notification on how compliance with Section 106 of the National Historic Preservation Act of 1966 (NHPA), as amended, would be demonstrated.

Subsequent discussions between the NRC staff and USACE have determined that the USACE would be the lead Federal agency for Section 106 of NHPA for the proposed project and consultation with the Federally recognized tribes for cultural resource issues. The NRC will continue in its current role as the lead agency in producing the draft environmental impact statement (EIS) but will turn over lead agency consultation responsibilities to the USACE to fulfill the Section 106 NHPA responsibilities. USACE will follow the consultation process outlined in its Procedures for the Protection of Historic Properties, under Title 33 of the Code of Federal Regulations, Part 325, Appendix C.

The NRC staff will also forward the draft EIS to the Poarch Band of Creek Indians for review and comment and will address any comments provided in the final EIS. The anticipated publication date for the draft and final EIS is February 2015 and February 2016, respectively. Prior to those publications, the NRC and USACE would like to provide a project update tentatively scheduled for October or November 2014. The face-to-face meeting request will be routed through Mr.

David Pugh, USACE archeologist.
